Ummm re-read my post again, ANYTHING BROADCASTED IN THE PUBLIC AIRWAVES IS UP FOR GRABS, the FCC says so, and like I said, I did NOT wanted this song to be in my video, I'm also being infringed upon, to who can I complain?

This isn't entirely Google's fault (or YouTube). It's the sue-happy IP lawyers.

A few years ago, shortly after Guitar Hero III was released, I uploaded a popular video of the Wii Les Paul guitar being used via Bluetooth on a PC (with the PC version of GH3). At first, this was pretty unusual because GlovePIE hadn't been updated with specific support for guitar controllers. The video was pretty popular. Because of the song in the game, some record company claimed rights to my video and they are now profiting from ads placed over the video. I also can't correct details or add annotations. Also, the video is restricted from viewing on mobile devices...so I can't even look up the URL right now.

I won't deny that I'm ignorant of Canadian laws. However, I posted a Canadian law that says it is illegal. You just keep saying it's legal without posting any proof.

I made a funny fishing video with my friends and used the dueling banjos from "The Deliverance" as the background music. Youtube did what you said. So I found (on Youtube), a really good rendition of the same song live by some guys. I downloaded and ripped the audio and used that, no problem. So it really depends, its smart, but looks for the exact music.

Yeah,

I currently have a music video up of Radien vs Vamp from when MSG4 first came out. I have two audio tracks playing on top each other, (you can't notice, unless you are very familiar with the primary song) , but the google tool can't pick it up.

I'm surprised the OP's video got flagged, that must have been some pretty crisp audio from the recording.

You don't generally ban people for being trolls either, or theflyingpig would have been permabanned a long time ago.

Even if the YouTube of 2005 allowed "everything," they would DESERVE to be sued if that was the case!

Youtube now has Orwellian special filters, thanks to Google's takeover, that automatically bans your videos if it has restricted audio DRM or key words or tags that are not supposed to be there.

I uploaded a video of my family in our vacation in Florida, there was a song playing in the background from the hotel's radio speakers, when I uploaded my video to Youtube it automatically banned my video for audio copyright infringement of the song playing. STUPID IDIOTS, THE RADIO STATION PAID THE FEE FOR ITS RIGHT TO USE THE SONG AND IT WAS BEING BROADCASTED IN THE AIRWAVES, WHATEVER SONG IS BROADCASTED IN THE AIRWAVES BECOMES PUBLIC DOMAIN, READ THE FREAKIN F.C.C. RULES YOU STUPID RETARDS.

lol at the young idiot.

It is absurd, this should be covered by fair use. No one in their right mind who wants whatever music was playing in the background will choose to listen to a crappy background recording of a segment of it that was incidental to the video posted. That it is not covered by fair use shows the screwed up mess congress has made out of IP laws in the past 15 years.

It may very well be covered by Fair Use, but last time I checked, Youtube/Google is not a government agency/prosecuting people for copyrighted music. It's a company offering a service, and can make whatever the fuck rules it wants so long as it's not running afoul of actual laws (such as a "no black people allowed to upload videos" rule).
