GO with Motion Man on this one you just have to bring up doubt in the judges mind that the cops word is not 100%

Since the dispute is over whether the light was green/yellow or red, anything that you can bring up to attack the cops ability to observe and report is relevant.

"Your honor, how can you trust that the office saw a red light and also saw my car allegedly not yet in the intersection in a brief moment when he could not even accurately note our location given all the time in the world to write it on the ticket?"

Remember, OP is not disputing that he was at the actual location. He is only disputing the cops ability to accurately observe and report.

True- but again, there's no reason for the judge to believe OP wasn't at the location on the ticket- just becomes his word against the officers

Couldn't you then ask for traffic tapes of the area on the ticket to prove the OP wasn't there? Worst case you aren't there and prove the cop was wrong. Best case they say fuck it and dismiss the case.

If the cop lies under oath and says OP and the cop were at a totally different location (i.e. the one on the ticket), then OP should immediately ask that the proceeding be recorded (by a court reporter) and have the cop repeat his statement. then do a freedom of information request for the cop's records from that day, get him fired for perjury and THEN get OP's ticket reversed.

Or something like that.

I was en route to girlfriend's house. If need be I can have her testify to say that I arrived at X time, which would make it impossible for me to be at location of ticket...or just do what motionman said lol :)

However, my question now is what do I say when I get there because the ticket says "Obstructing Traffic"? Do I tell the whole story when put in front of the judge?

Don't think he'll lie considering he was a township cop and the town he wrote down I don't think he even has jurisdiction in? It's really weird...I have no idea why the hell he wrote "Route 66/Hamilton".

MotionMan, I don't think you've been to traffic court very often. There's no such thing as practicing law there. You do not get to ask questions, you do not get to make statements, you do not get to tell your 'side' of the case. You answer the judges questions period.

Unless, of course, you want him to go out of his way to screw you for interrupting the court and taking longer than the 4.5 minutes he's allotted for your case, next!

OP, go to court. You've probably got a 50:50 chance as long as you don't try to practice law.
