Writing a paper, tired, can't understand...

I'm really tired right now, and I'm trying to write a paper for a legal studies class, about copyright infringement. I got this quote from the US code 17 1008:

No action may be brought under this title alleging infringement of copyright based on the manufacture, importation, or distribution of a digital audio recording device, a digital audio recording medium, an analog recording device, or an analog recording medium, or based on the noncommercial use by a consumer of such a device or medium for making digital musical recordings or analog musical recordings.

I can't figure out what this is saying. Is this a correct paraphrase:

Nobody can sue anyone for making, or selling digital audio equipment (ie CDRW drives) or digital audio mediums (ie mp3). Consumers may make digital recordings as they please so long as it is for noncommercial use.

If that's right, then I can make a copy of my Cd, you can make a copy of my copy, and ....

HELP!

Yup, looks like what you paraphrased was right.

But i'm not too sure if you could make a copy of a CD and still be within the law though, because it doesn't say anything about making copyrighted material. Guess that's the loophole.

Well...you paraphrase should include "under this title" there may be other laws governing it. The litigation may be based on a different statute, not just this one.

Are you writing this paper with a pirated version of a word processor, while listening to pirated mp3's you illegally downloaded from warez sites? ;)
