I ordered a phone off ebay and I go to activate it and it is associated with another account. the seller (phone store) is offering a refund but I have to pay shipping and a 25% restocking fee..WTF? When I lost my ebay dispute I wasn't able to keep 25%, what are my chances on this?

Cliffs: Sue. Seriously. If your story is legit, you should get a no cost to you refund. You bought a likely stolen phone that should be in use by someone else.
 
A return policy is one thing. Enforcing it when the buyer does not want to return the item, but has to because they can't activate is another.

I bet this kind of thing is a regular scam. You put an item up that you know doesn't work, and say you've got a 25% restocking fee. Sell it, get it back, keep 25%, repeat.
 
I'm on phone with paypal and they said the sellers can put whatever terms they want dealing with returns but when it comes to a dispute that flies out the window. Now if I worked with the seller through email and not ebay/paypal dispute he could get away with the 25% restocking fees

IMO, Ebay has gone to shit...and there are so many scammers that it's not worth taking the chance anymore.

If enough people would boycott ebay, MAYBE they'd crack down on the bullshit sellers and make the place buyer-friendly again.
 
You can call the police department in that county. They'll give him a call and it'll scare him enough to do the right thing.

I've had to do it before.
 
That sucks. Paypal usually bends sellers over when they are in the right, so I'd be surprised if they didn't in this case when they are in the wrong.

From talking with paypal, sounds like you need to cease talking to the "store" and let paypal save you the restocking fee.

I've bought loads of stuff on ebay and never encountered a scam (hmmm....I hope saying that doesn't jinx me). Though I almost never buy anything costing more than $10, which might be the reason.
What I find baffling is the frequency with which I'll see things go on ebay for _more_ than they cost new from Amazon.
 
How much of a discount did you get from full retail? I was wondering because I would have to get a huge discount to accept the risk of buying a phone on ebay.

Agree that once the dust has settled that you leave either neutral (seller accepts return with full refund) or a NEGATIVE. Negative feedback can have a powerful effect on some sellers. Earlier this year I bought a car ECU from a yard in TX. I plugged it in and it displayed faults. I tried over 3 weeks to get them to respond to my concerns but got nothing but silence. They responded the same day I posted negative feedback with an apology AND a full refund including all shipping charges.

Scammers would be stopped in their tracks if people would give them negative feedback when deserved. They wouldn't achieve 500 sells with 99% positive which gets more people to trust them.
 
yeah it does seem like ebay has gotten worse since they changed the rules.

i would put in a thing with your CC and call the police in his area.

Except do you know how easy it is for said doucebags to get negs removed? Yeah. It's that easy.
 
I have no problems buying stuff on eBay, because the buyer is always right. I am very very nervous about selling stuff though.
