WOW.. ebay dispute... I win?

This guy bought an apple cinema display from me on ebay.

I didn't have a way to test it so it was AS IS. I'll spare all of the details. We've had some nasty emails . He said it was broken.. i started a ups claim, then he told me it was internal damage.. .etc. He's wanting a full refund even though I incurred $33 in ebay fees and $50 to ship it.

Now he's filed an ebay claim and my paypal account is automatically -$286! OMG!

I'm just curious so I just on pipl.com. And guess what?

He is a registered sex offender!

How funny is that?


Based on the grounds of the item being listed 100% correctly as not working, I already feel 100% that I'm in the right there... But then I have the secondary moral victory knowing this guy is a lowly pedophile.

Paypal will try to hold the balance till the dispute is over.

I have won 2/3 disputes as the seller.

I also consider myself lucky
 
Yeah, The dispute process is totally skewed toward the buyer.

I actually buy a ton of as-is stuff on ebay and I know that it's as is. sometimes you get lucky sometimes not.

I got an as is dell system once that I ended up parting out for almost $1300... and then I've bought lots of hard drives where all but one work...

This guy bought an item listed as is not working, and then found out he couldn't harvest the parts he wanted from it and then got mad.

Regardless of the outcome, I have the morally victory because I'm not out messing with 11 year old girls.

Anyway, hope you win the case. Seems like a slam dunk if you listed it as-is and the description was accurate (to the best of your knowledge), but this is eBay/PayPal after all, so who knows.
 
AS-IS. Means AS-IS, no guarantee of condition or functionality is implied. Did you listed the condition as For Parts - Not Working? If so, he has no claim. If you listed it as any other condition, you're screwed.

It was clearly listed as is/ untested and ebay recently added " AS IS / NOT WORKING " to the drop down for item condition.

My beef is that i paid nearly $50 to ship it from my credit card.. the money he paid me is already gone, $33 in ebay fees for it have already been paid to ebay, my $70 paypal balance is now gone, I just refunded somebody from here and instead of sending them back their money, I sent them $22 from my bank account.

Ebay has skewed so far on the other end since then that it's ridiculous. Unfortunately for a lot of people it's the only game in town to buy/sell stuff with enough eyes on an item to make it worthwhile.

9 years ago it was for the seller. NOW its for the buyer. its so far in favor of the buyer i don't use it unless im buying.
 
You have a link to the auction? I don't see how you could have listed condition as "not working" and lost the case. eBay and PayPal can be pretty inept at times, but usually when an issue is this clear-cut they side with the seller. It's only more ambiguous cases where they tend to side with the buyer instead.
 
That's some BS. There's no way to appeal the decision is there?

Does the guy even have to ship the monitor back or is eBay letting him keep it *and* the money?!

Just thinking about it makes my blood boil... I can only imagine how you feel right now.

No, people who buy expensive junk reap what they sow. He was clear in his ad; "AS-IS." The buyer is just pissed his gamble didn't pan out for him... but make no mistake, this was the BUYER'S game, not the seller's.
 
Not to mention one man's junk is another man's treasure. For example if you're handy with a soldering iron, you can make pretty good money on eBay buying non-working LCD monitors, fixing them by replacing old/bulging caps, and then flipping them for a profit. A lot of people do this on eBay with all kinds of products. Number1, if you're trying to claim that people shouldn't be selling broken parts on eBay, that's just ridiculous. As long as sellers are upfront about the item's condition, there's absolutely nothing wrong with it. It's a win-win, sellers can make a little money off something that's worthless to them and would just be donated or thrown away and people who have the skills to refurbish these products can fix them and resell for profit.
 
oh, never mind... Ebay refunded mr sex offender without reviewing the case.

So because the guy is a sex offender, ebay should rule on your side of the case?


I don't see how him being a sex offender should matter in the slightest way to ebay or whether or not he deserves a refund.
