The burden of proof is on THG only to prove that the statements were harmful, and then only to collect money.

I'm sorry grant2, you are simply mistaken. If someone (in this case THG) accuses someone else (Ryan of AMDMB) of libel in the U.S.A. the burden of proof is upon the accuser (THG) to prove that the statments made are in fact libel (which is probably exactly what his lawyer told THG which is why they backed down).

Irving sued Lipstadt for libel in London, where defendants bear the burden of proof. In the U.S, plaintiffs must prove statements made about them are false, but British courts don?t honor the U.S. Constitution?s First Amendment, guaranteeing freedom of the press. A recent New York Times article says British libel laws make London ?a magnet for litigators.?

I doubt there is any reasoning besides that Kyle does not want to see big dogs like THG just bully others. And I'm glad to see the support from Kyle, it gives me back alot of the respect I used to have for him. And the whole thing he's been pushing with benchmarks is a good thing too IMO.

I for one am inclined to beleive Ryan.... first he has no reason to lie.... mostly he would end up hurting himself. Also the one other online media was ASKED by THG/AMD to hold off on their coverage... they agreed, that does show me that THG was trying to get first rights to it. And look at moron Omid's responses.... their nothing but childish mud flinging, they don't even really defend themselves, they just show me that they are jerks enough to do it.

I doubt Kyle's jump to aid Ryan was to stop "big dogs like THG from bully others". He did it because he can't stand THG. It started when Tomas said tech sites shouldn't stop publishing in the wake of 9-11. For some reason this pissed Kyle off so he banned linking to THG in the HardOCP fourms (for almost a year) and banned a few people that spoke up for THG.

Kyle is not alone in that point of view. You should be smart enough to realize that saying that everybody should just forget 9/11 and go on with life as normal only a week or so after the tragedy is a plenty good enough reason to piss off the majority of your American audience. If the Europeans want to go on with life as normal, that's fine, but don't fvcking tell us as Americans what we have to do on our tech sites.
