would it be a dick move to steal back my desk?

so, I'm starting in a new department next week at work... like a month ago, in preparation for my arrival, our internal IT guys setup a desk for me and gave me second pick of desk locations since my department in my location was being moved and it's only me and one other guy that's going to be there full-time.

in the interim, two weeks ago, a guy who works in our NYC office decided he'd like to work out of jersey a couple days a week. the first thing he did when he arrived in the NJ office was decided that my future desk was going to be his new desk, despite the fact that the other guy who works out of NJ full-time told him it had been setup for me. he took the name plate on the desk and moved it, wiped my extension/voice mail config off the phone, put his on there, and proceeded to make himself at home.

cut to this week, I find out that his wife is having problems and he's going to be working from home full-time for at least the next month... would it be a total dick move to use him working from home as an opportunity to steal my desk back?

to head off any questions... he obviously has department seniority over me, but I've been with the company 2-3 years longer than him. we're in a quad, and two desks (the desk in question + my other coworker's desk) face a wall so that you can actually see the room and not worry about anyone looking over your shoulder (not that I nef a ton at work, but you know... sometimes you've got a minute or two to kill while waiting for a server to reboot or a client to call back).

You were simply letting him borrow your desk all this time, since he was gone, you decided to take the desk back since nobody was using it.

Here's a stupid question, but have you tried talking to him?

never bothered because I wasn't going to make an issue of it with him here... but since he's not going to be here for another month...

Definitely steal it back. If he questions your motive kick him in the junk before he has time to think.

Not only should you take it back, you should wipe his phone and place his shit somewhere else in the office.

Just take it up with your superiors about his initial actions before you take the desk back. Otherwise it could escalate, bigtime.

Exactly. The jerk took your name plate off the desk. It's your desk. You're not taking it back because it was never his.

I think you should find out what car he drives, key it, pour paint thinner all over it, pour sand in the gas tank, and slice all the tires.

Dude, if your boss didn't do anything about it; you probably should learn your role there.

my boss is 2,600 miles away and from what I know of him, I'd guess he wouldn't care one way or the other.

No, it's not a dick move. Him taking it in the first place, that's a dick move. Especially considering he doesn't work in that office full time. I say you're well within your rights. Worst case scenario, he uses his seniority to force you back to your old spot and causes maybe a week of minor friction between you (which is only 2 work days).
