Would a police officer require a search warrant to have you remove your tinted glasses and check your pupils? or would he be able to justify probable cause based on your behavior?

Probable cause is all they need. Are you going to try and drive drunk with your sunglasses on, presumably at night?

sure...you could give them a hard time about the glasses....then they could place you in handcuffs "for your protection", then take you in to get fingerprinted to confirm your identity....hope that would be worth all the hassle

Your pupils are public property and can be observed at any time by a duly sworn officer of the law. If you resist they can remove them to be taken to a lab where they will undergo further scrutiny!

I don't think it matters how your pupils look. As long as you are aren't driving or doing anything illegal, a police officer can't do anything to you even if your pupils are as big as your eye.

Actually, I have driven home while a bit intoxicated once and I found that wearing sunglasses at night improves your concentration. It makes you strain harder to see what you're heading for when it's dark out... Just a little tip (but first, dont drink and drive like I did)

from what ive been told, if you come across a dui checkpoint or something, when the officer flashes his light in your face, he gets his answer to whether you were drinking or not. supposedly when you drink, veins or the skin-tone of your eyelids slightly change, they become darker, and thats how officers can tell if youve been drinking or not. theyre flashlights somehow make it show up. that right there would give them reason for probable cause and ask to check your pupils afterwards. if anyone can shed any more light on the flashlights and the eylid theory, id love to hear it. its been awhile since i was told about it, so my facts are a bit sketchy.

Well, a lot of people have red and watery eyes while they drink. Another thing is that there is a BAC test that you think is a small flashlight. You think he is shining it in your eyes but he is really holding it near your mouth to get your BAC.

drinking doesn't really affect most people's eyes as much as, say, some other substances.

thats interesting. i always figured you had to do the breathalizer to ultimately determine if your drunk (or blood test), and even then, you had to do the test properly or it comes up inconclusive. now they have it where they test your breath without the device even physically in your mouth? neat. ty for the info millennium
