Dawn Welsh thought her house was paid off. She received paperwork from her bank showing it was paid off, but through a series of her mortgage being bought and sold, Wachovia Bank was the final owner of the mortgage and claimed Welsh was still owed on her home despite papers showing otherwise.

Today, Hillsboro, Missouri police came onto her property and broke her door down to remove her from her property near St. Louis. They used a battering ram to enter her home, despite her showing evidence in the past that she owned the property. She had gone to court previously and showed a judge the mortgage was paid in full, and it is a record of the court. However, these are desperate times for Wachovia who continued to threaten the 54-year-old woman.

These paperwork problems aren't uncommon. In fact many people wind up in court after they are told they owe more money on their homes after a series of mortgages being pushed back and forth through the mortgage process.

Wachovia Mortgage took over the mortgage and said they weren't going to honor the paperwork from the previous mortgage and continued to harass this woman. So we have a woman with the proper papers showing her house is paid off with the police and the courts ignoring the paperwork according to the story.

It seems so fitting that the banks have become so desperate to make up their losses that they are bullying themselves over hard-working people in scams to collect even more from the mortgages. They have received hundreds of billions from the taxpayers, and yet they pushed this lady into the corner.

Property rights are definitely in question in the United States and with the government's interest in the banks, we might see more of this as the government looks for sources of income to fix broken programs that are running out of money. Will they go as far as confiscating property through the banks? That's the real question that comes from today's story.

Obama ran on the promise that he would help people like Welsh, but this may be the reality now the government is running the banks. This wasn't supposed to happen under Obama's promise of hope and change. Is confiscation of private property going to further spread across our country. We know the government has used eminent domain laws to confiscate property which they can make more taxes from by putting a business where a person's home was. Now with the power of the banks, they may be able to take it many steps further.

Obviously SOMEONE screwed up here, but we don't know if it was
1. Wachovia
2. The bank that previously held the mortgage
3. The homeowner (in addition to the bank that previously held the mortgage)

Since the previous bank apparently -
1. Sent the woman papers indicating that she had paid off her mortgage
AND
2. Sold her mortgage to Wachovia

I'm thinking the previous bank screwed up. It shouldn't be possible for both of those things to happen.

thats a good question too.

im hopeing this gets on more news sites. with more information either way.

either this women knows she owes more money and is trying to scam them since she has paperwork or its paid off and the bank is trying to get the house it thinks it owns.

i would thinkt hey would look more into it before they took such harsh measures.

I agree with you here but if this were the case... why then is Wachovia the one barking all the orders... because they have a bigger legal team? If the previous bank screwed up then the status of the mortgage should be at a neutral state where it is uncertain who owns the house except right now Wachovia is doing all the bullying here.

This lady should go to local news if everything is as cut-and-dried as it's made out to be here.

Well it can be as onesided as it is, the proof is still there that the lady had a written letter from the mortgage holder that the house was paid off. She even had gone to court over it and they had papers saying it was paid off.
Imagine if this happened to someone that doesn't let others pull shit on them. It could have easily turned into a shoot out between a home owner and cops.
Anyone breaks my door down, they're gonna get shot at because I know I haven't done anything wrong and I stand up for my rights and my principles.

Yes, this.

It could be a simple as Bank A sold the mortgage to Wachovia and then Bank A sent the lady a document stating she no longer owes Bank A any money and neglected to inform her that she now owes Wachovia for the mortgage.

Paperwork errors are the number one reason I have always made it a point to ensure that a mortgage charge is taken off of the title for any property I own by requesting a title search which will prove that I have paid off the mortgage.

st. louis county circuit clerk does not appear to have it's cases available online, otherwise we might be able to look up this lawsuit
 
Your post doesn't clarify whether or not she actually paid off the mortgage. She may have received a letter saying it was paid off when it wasn't actually so. Unlikely but just pointing that out as a possibility.

I haven't seen this proof. You haven't seen this proof, have you? Supposedly a judge has seen this proof, and yet this woman was removed from her house. It seems this proof is not absolute.

This is the problem with a one-sided story. We only get one self-serving point of view. The "article" lacks information that should be included, which implies to me that that information may have been left out because it's not self-serving.

agreed. I don't think Obama demanded that Wachovia take her home from her. I'm sure he has more pressing matters to deal with.

With Wachovia purchasing WaMu, along with other mortgages form other defunct banks within a span of less than 1 year, it's way more than reasonable that this is a problem of jumbled paperwork, and the overall historical shittiness of how banks view the value of their own property.

Hell, I remember Chase screwing around with their system for nearly a year back when they bought BankOne. If a bank can't get their shit together when times are supposedly good (I probably received about 5 new debit cards within a 4 month period when my account was moved to Chase), how can anyone expect them to function well in this crisis?
