HOUSTON (FOX 26) - Ethel Easter says she broke down and cried when the doctor told her she would have to wait two months to schedule her hernia surgery at a county operated hospital.

“I was like, 'I can’t wait for two months.' I’m terribly ill, and he said 'listen' he got very abrupt. He said 'who do you think you are? You have to wait just like everybody else',” Easter said.

The doctors tone Easter says made her decide to tape record her surgery.

“This is my natural hair I had a weave at the time which is braid extensions and when I put my hair up I put the recorder right in my hair,” said Easter.

Soon after you hear Easter start to snore on the tape she says the surgeon tells others in the OR what he thinks of her.

Surgeon on tape: “She’s a handful she had some choice words for us in the clinic when we didn’t book her case in two weeks.”

Other male voice on tape: “Really”

Surgeon: “I’m going to call a lawyer and file a complaint” (laughter)

Other male voice: “That doesn’t seem like the thing to say to the person whose going to do your surgery”

Easter says some of the OR staff made disparaging remarks about her body. You can hear a nurse in the OR laughing about it.

“Did you see her belly button?” says a female voice on the tape which is followed by laughter.

On the tape you can hear a male OR staff member say to the anesthesiologist, "Precious meet Precious,".

“It was Precious meet Precious, as though I was this big fat black woman,” Easter said.

Easter says you can hear some OR staff members refer to her as “always the queen” and then the surgeon repeats the phrase and says he feels sorry for her husband.

“When I heard the comments on the tape and listened to them I was shocked,” said community activist Quanell X. “I had no idea that doctors, anesthesiologists and nurses would carry themselves in this manner in an operating room.”

A spokesman for Harris Health System which oversees the county operated hospitals declined comment citing patient confidentiality laws.

In a letter sent to Easter Harris Health System states we have used this opportunity to remind the OR staff and physicians to be mindful of their comments at all times.

I don't really think a knocked out person counts as a consenting party to a conversation. In fact, that they were ok talking about her implicitly shows that she wasn't party to the conversation. In Texas that is $10k plus whatever damages her release of the info causes in civil penalties, as well as any criminal penalties.

Does Texas have a single part consent law for recordings?

Edit: Just saw post above, good point, was she even a "party" in the conversation?

didn't she break the law?

Texas's wiretapping law is a "one-party consent" law. Texas makes it a crime to intercept or record any "wire, oral, or electronic communication" unless one party to the conversation consents. Texas Penal Code § 16.02. Therefore, if you operate in Texas, you may record a conversation or phone call if you are a party to the conversation or you get permission from one party to the conversation in advance. That said, if you intend to record conversations involving people located in more than one state, you should play it safe and get the consent of all parties.

well..for the first part when the doctor scolded her on demanding the surgery NOW i agree with. It's also really silly to threaten the guy who is doing it also...

Ferz brings up a good point. She was not part of the conversation. recording and releasing it? hmm

Waaaaah, fuck all those other patients! Operate on me now!

Entitled bitch. Screw her.

Why was she recording to begin with anyway? Does she just walk around recording everyone secretly in hopes of catching some imagined racism?

wow, she sounds and behaves exactly like the entitled drama queen she is; whom of course hates hearing a room full of intelligent people tell it like it is to the point they clearly don't respect her for the same reasons she recorded them.

Let's secretly record this woman and her equal-justice activist friend 24/7 and see what mean things they say behind someone's back.

Can't wait until someone invents a mind reading device and we can call people out for thinking things like this. Because that's what this claim basically amounts to, thought crime. They keep talking about how this reflects badly on the standard of care she was given but it really has nothing whatsoever to do with it.

And this claim that she was doing it so people would know what happened if she died on the operating table.. I don't believe it for a minute. She was almost certainly doing it with the hopes that they'd say things like they said and she could get sympathy and possibly a lawsuit, maybe a termination.

The "truth" hurts, doesn't it?
Maybe if they made complimenting remarks on her appearance she'd be overjoyed.

Yeah, good luck with that.

I find their comments inappropriate.

I don't see why she would get money, but I do see why they would get disciplined.

Instead of being a whiny bitch about it, I would have linked the video to all the google review pages for the doctor and been like "This is the level of professionalism you can expect at XYZ".

Well, YOU ARE a fat black woman!, own a mirror Precious?

"In a letter sent to Easter Harris Health System states we have used this opportunity to remind the OR staff and physicians to be mindful of their comments at all times."
Translate, "low-life's will get very creative to find a means to file a lawsuit, be careful!"

I have a lingering question about consent. When on the phone they say "This conversation may be recorded for quality assurance purposes," is that also a permission for you to record?

Did she have permission to record? Why is she not being booked? because she is minority and fat and female?

Jeez. That's not body shaming her, they thought she was unconscious. This is just lawsuit trolling.

Just another tick hoping to be carried higher on the dog.
