According to this article, an unemployed woman (age 35) with 9 kids went to the doctor for an IUD and received a tubal ligation without her consent and now she's suing.

http://www.inquisitr.com/55174/unemployed-mother-of-9-suing-over-unlawful-sterilization/

What do you think? Should the hospital and doctor have to pay her money? Was a crime (battery) committed?

I think that a tubal ligation for her is a good thing, but it's not really the hospital's nor the doctor's job to decide that, at least not under current law. Note that he oldest is age 21, so she started popping out pups at an early age--14, possibly with conception at age 13.

Do you think that any of the kids' fathers are named Clevon? (See the movie Idiocracy.)

The mystery is why this happened. We have nothing but what she said. Nevertheless, if all is as she says, this should not have happened.

This is one of those situations where I have to defer to her rights, however the last thing we need are ho's pumping out kids that she can't even raise. She farmed them out to her parents. Damn good thing I'm not king.

Yes she's an idiot but the taxpayers of Mass. get to support her a** and her kids. Hope they get their $$ worth. Not.

My mom had 8 and while many here might say she should have been sterilized for Zebo wouldn't be here, some us grew up to be something. Yes they should be sued like a mofo. I'd give her at least 10 million in punitive damages to make hospital think twice.

Eight kids, eh? Were they extra paychecks for her? Did she reach her limit on how many she could tend, then farm the the extra out like cattle? I'm guessing no.

Yes she was deprived of her rights, but she's hardly one to hold up as a paragon of responsibility. Far from it.

payday for her

Yup. I wouldn't be surprised if she really doesn't mind at all (heck, she didn't want to have any more kids since she was going in for an IUD) but just wants to make some money out of it.

Realistically, this is probably the best thing that's ever happened to her in her entire life--she's sterilized and she's going to get paid.

Somethings not right here, an IUD is placed in the office while a tubal ligation is done in the OR under anesthesia.

The cneter can not locate the medical records.

Feedback from the MD the performed the operation is required for proper evaluation.

She seems to be creating issues for $$.

According to another article it happened when she went in for a C-section (she was having the IUD put in after it)

LOl you bunch of clowns, don't you know that Google is your friend?

http://news.bostonherald.com/news/regional/view.bg?&articleid=1222682&format=&page=1&listingType=Loc

.
.
.
Tessa Savicki, who has nine children aged 3 to 21, claims doctors were supposed to implant an intrauterine device, which is a type of reversible birth control, after she delivered a son, Manuel Flores, on Dec. 19, 2006, at Baystate Medical Center.

Instead, she said, a type of permanent sterilization known as a tubal ligation was performed, leaving her mentally distraught and incapable of bearing more children
.
.
.
Savicki said she did not sign a written consent for a tubal ligation, which under federal and state regulations is required at least 30 days in advance for all MassHealth patients who want a permanent sterilization procedure
.
.
.
Borten (Savicki's lawyer) provided the Herald with a Baystate Medical Center letter on Savicki’s case, signed on May 22, 2009, by an employee of the hospital’s Health Information Management System department. It reads: “We regret to tell you that in spite of carefully and thoroughly searching, we have been unable to locate the following medical records: ‘Tubal consent form for December 2006.’
.
.
.
Savicki said she brought the IUD into the operating room, unopened and in a box, on Dec. 19, 2006. She said she handed the box to the nurse prior to the planned Caesarean section. Her medical record notes that the IUD was to be implanted following delivery, according to the complaint.

Post-delivery notes indicate she received a tubal ligation, the complaint says. The surgical notes were reviewed by the Herald
.
.
.
Savicki has nine children from several men, is unemployed and relies on public assistance for two of the four children who live with her. She receives supplemental security income, or SSI, for a disability, non-Hodgkin’s lymphoma, she said. Her mother has custody of three of her children. Two of her children are no longer minors
.
.
.
Savicki said she’s been in a relationship with her fiance, Angel Flores Tirado, 36, since she was 25. She lives with him and the couple’s three children. Tirado helps support the family with his full-time job as a personal care assistant. Savicki said she’s had eight of her nine children while in committed relationships and hoped for one more child with Tirado.

“It’s not like I’m jumping from guy to guy to guy to get pregnant,” she said. “I’m trying to make a healthy home for my children.”

Semms to that most of the ASSumption being made by the tightie righties are wrong?? Imagine that!!

Really? She sure had me fooled. Note that the word "jumping" should really read "humping".

Thanks for digging up that article that provides further detail, Nobodyknows.

If I were in charge, I would have done the same thing. This person is sucking away taxpayer money with all those dam kids.

You see, you should wait until the tightie righties pass tort reform for healrh care and then you can do whatever you want. Just remember to says "Opps!" afterwards.

Remember folks, every sperm is precious. And if you have so many kids that you can't take care of them, then you can just send' em off for biological experiments.

Judge not, lest ye be judged.

I try not to judge but I have to agree that a single mom (especially one with cancer) really shouldn't be having more kids. That's still no excuse for tying her tubes.

Regardless of her apparent complete lack of worth as a human being, the hospital would be in the wrong to do a tubal ligation without written consent.
