I can't get into violent mode when it is daytime or even have the option to use my sword ever on innocents.

It always gives me the talk option

During day time in safe zones you're not allowed to take out your swords, unless you get attacked first. That sounds reasonable, don't you think? Imagine taking a gun out in the middle of the day in a city central. Last time I checked that's not allowed either :p

If you really have an itch to kill innocents, you need to do it during night time.

You're a violent person, Mizzou. We're not going to see you on the news involved in a school shooting or something, are we?

The OP is talking about swords here, I see no mention of guns or anything that shoots for that matter.

mizzou, if you want a sandbox to slay the innocent (personally, I find it distasteful, but if that is what you enjoy in your video games then have at it), might I suggest the Grand Theft Auto series? It is more focused on that. They were on sale via steam recently and you can download / install / play them from the comfort of your couch (assuming you have your PC hooked up to your big screen TV in the living / killing room).

no no no, don't get me wrong, I'm not itching to just go around slaying humans but I was just dismayed that I didn't have the option so I thought I was not understanding part of the controls.

The story and environment is immersive enough, sometimes though I do have that urge to knock off a couple peasants and thugs when nobody's looking though =)

Witcher is not like Oblivion in that respect, you can't just attack at will. It sets the cities up more like a Final Fantasy game except when they become a combat zone at night.
