Win2k harddisk problem

I need some help, my 40Gb ABR 5400rpm ATA-100 Maxtor that keeps hanging (disk light on, everything freezes)whenever I do something disk intensive (or sometimes not so intensive at all), while installing games and programs. SiSSandra's disk benchmark won't finish - I have to kill the process after about 5/6 minutes or does it actually take much longer to complete?? I'm pretty sure the drive is ok. Its brand new and its not making any noise at all, did a surface check - ok.
I can have no problem with sound or gfx - ran MadOnions 3dmark (took 3 tries to finish installing it), or at least not until I can finish installing a real game properly!

My specs:- win2k sp2, via 4in1 v3.34, via MPD v3.0.14, dx8.1, nvidia v21.81, Epox 8kha+, 40Gb Maxtor primary, Liteon DVD secondary slave, Liteon CDRW secondary master, 80pin cables for both ide headers and not overclocked at all, sblive pci-4, dlink NIC pci-5.

I'm having this problem with stock win2k sp2 drivers, via 4in1 4.37a and the via MPD v3.0.14. The miniport via driver seems to help a little but still very unstable. Same goes for turning down DMA->PIO mode, it helps but it would really suck if I had to run in PIO mode. I know Win2k has no native support for ATA-100 but I thought it was fixed in sp2?! I'm running via 3.34 because it came on the Epox cd. Is this a problem with all ATA-100 (UDMA5) drives??
