Win10 a spyware and trojan horse?

They backported some of the telemetry functionality as Win7 and 8.1 recommended updates:

I've since uninstalled/hidden and changed my Windows Update setting to ask to download only important (read: security) updates.

Doing this seems pretty pointless if you can just tell Windows 7 and 8 to simply not collect the data in the first place.

Do these updates change eligibility for disabling telemetry?
