Yes, I thought all aftermarket tints were illegal in NY, but apparently that's changed. (or maybe they changed it to all after market tints are illegal? Regardless, it changed from one to the other)
Anyway, the 70% for NY means 70% of the light has to pass through... not that 70% can be blocked.
edit: and that includes the back windshield, unless you have side view mirrors on BOTH sides of the car. (which most cars do)
