Will my Public. Intox. ever come off my record?

I was in a fraternity my first semester of college and I got a Pub. Intox (misdemeanor). It hasn't prevented me from getting any jobs the last 3-4 years, but I'll be finishing up college in the next year or two and I would like to be able to answer "no" when applications say "Any felonies or misdemeanors?". I figured it dropped off after 3 years or something, but someone recently told me once you get a record, you have it for life, unless you get it expunged with a lawyer. Is this true? Thanks!

Ive heard anywhere between 5 and 7, I imagine it depends on the type of job you're looking for. Expect longer if you're going to be working with children or as a public servant.

Correct. They're looking for felonies, not minor misdemeanors. Speeding and parking tickets are even more minor, legally known as infractions.

I think it usually says "felonies or first degree misdemeanors." I think it usually means have you had to serve time.

Well, there have been two instances where my PI came up. First, I have a real estate license. They would license me until a investigator came up, interviewed me and checked things out.

The 2nd thing was my current position's job app. It requested felonies AND misdemeanors. Like I mentioned above, it didn't prevent me from getting the job (matter of fact my interviewer jokingly commented that more college students probably have PIs than college students without PIs) but it would have been much better to have a clean slate.

Do they ask you if you have any felonies or misdemeanors "on your record," or do they ask if you've ever been convicted of a felony or misdemeanor? Think about it.

Good point mugs. But I've had two places pull record to verify my answers, so I would assume that employers do the same. The Ky Real Estate Commission pulled it as a part of their character investigation, and when I tried to help coach wrestling at my high school they pulled it and the school board told me to never show up to the school to help for anything. lol

Nothing ever comes off your permanent record. Those 3 weeks of detention you got in middle school? Yup, it's a black mark that will haunt you forever.

(At least if you believe the teachers at my middle school... :roll;)

Tell the truth about it always. You tell the truth and they see it is minor then it will probable not stop you from gettign a job. BUT lie about it and they see oyu lied about that and you pretty much have zero chance now.

I guess I'll call the family attorney and see how much they charge to get it removed. Probably just and arm and a leg like when they represented me for the PI ;)

Why not just say yes, Public Intoxication in a fraternity?
I doubt anyone who has went to college is going to hold it against you, since they know most people in fraternities are publicly or privately intoxicated most of the time ;)

I was thinking you be more worried they find out you were in a fraternity. :laugh:

What if it wasn't something minor but rather something big. Like embezelment or grand larceny. Think someone with that will ever be able to get a job? Maybe IT related.
