Why is Prostitution ILLegal . . . . but Making Porn LEGAL?

I know there's some loophole that said because porn is captured on video it is protected by the first amendment as free speech. But for some reason I don't think videotaping yourself banging a hooker would be defendable under the same law. There's more to it, but that's all I can remember.

Pornography has been protected under the first amendment as a form of speech...Supreme Court justice are VERY wary about giving types of speech value or imposing a sort of value scale on them because it starts a slippery slope.

The answer is simple. Women are keeping it from being legal. All women are whores in one way or another if you actually think about it since all of them at least TRADE sex for other things and if prostitution was legal then some women could loose their most lucrative and promising career....MARRIAGE. If you don't want kids what is the point of putting up with a nagging biatch who is only going to get old, fat, and more naggy?

The film and the right to make money off of the film are what is protected by the 1st Ad.

Once you start having the sex without the film being important, then there is no reason to protect the act that is not producing some money-making media.

They are inherently different.

Prostitution one party gets paid for sex, while the other is paying that party for sex.

Porn - The "stars" are paid as actors to shoot a scene where they have sex. They also pay the light guy, camera guy, director, etc etc. They are only paid because they know the movie is going to make money. If no one bought porn movies, then no one would get paid to make them. Also having scene the behind the scenes of a porn movie being shot, its not just two people having sex like the resulting movie makes it seem. They take direction, they stop, reposition, they do re-shoots sometimes. Its more like shooting an action scene for a movie, than a couple having sex.

Also prostitution isn't consider a safe profession. In porn they require regular testing, many studios require condomns, and the environment where they shoot is safe. No one is going to harm either party. Where as in prostiution, the work is done at night, usually late at night, the two parties most likely aren't acquainted, neither knows if the other is clean, and the safety of either party isn't guarenteed.

While porn might not be considered a "respectable professions", its not a visable profession. Most of the making of a movie is done behind closed doors where as in prostituion, the hooker has to pick up her trick, and thus is out for everyone to see. No one wants ladies of the night walking around on their streets.

the "time" of day has nothing to do with it and prostitution could be "safe" - IF it were regulated.

When porn was NOT big business - a few years ago - it WAS 2 actors and a cameraman. 😉

they are mostly called "models" by the Porn companies since they are NOT 'actors'.

and i believe anyone can get the permits [if necessary] to film porn in all states . . . OTOH you cannot get a permit for prostitution in most of them . .
