Porn is protected under the first amendment as a form of speech. You could argue that it is art.

They are inherently different.
Prostitution one party gets paid for sex, while the other is paying that party for sex.
Porn - The "stars" are paid as actors to shoot a scene where they have sex. They also pay the light guy, camera guy, director, etc etc. They are only paid because they know the movie is going to make money. If no one bought porn movies, then no one would get paid to make them. Also having scene the behind the scenes of a porn movie being shot, its not just two people having sex like the resulting movie makes it seem. They take direction, they stop, reposition, they do re-shoots sometimes. Its more like shooting an action scene for a movie, than a couple having sex.
Also prostitution isn't consider a safe profession. In porn they require regular testing, many studios require condomns, and the environment where they shoot is safe. No one is going to harm either party. Where as in prostiution, the work is done at night, usually late at night, the two parties most likely aren't acquainted, neither knows if the other is clean, and the safety of either party isn't guarenteed.
While porn might not be considered a "respectable professions", its not a visable profession. Most of the making of a movie is done behind closed doors where as in prostituion, the hooker has to pick up her trick, and thus is out for everyone to see. No one wants ladies of the night walking around on their streets.

BTW-I think prostitution should be legal. It is a victimless crime and at least if it were legal there could be mandatory testing for STDs and the police wouldn't have to spend so much time and money trying to arrest prostitutes and johns. The government would also increase revenues because they could tax the income.
This will never happen though. Never in a million fvcking years.

legally, the male "actor" isn't paying the female "actress" for sex. they are paid by the producer for their "acting" not just for sex.

Yea, I always thought the distinction was, the "actors" are acting in a movie with a plot (doesn't have to be a good one, as we all know) and that sex just happens to be a part of it. But they're paid for their acting ability, not just to have sex.

NO they are NOT paid for their "acting abilities". Most studio do NOT call them "actors". They are paid for their ability to portray sex on video. 😉

BINGO!!!
:shocked:Prostitution was legalised in Germany just over two years ago and brothel owners ? who must pay tax and employee health insurance ? were granted access to official databases of jobseekers.
The waitress, an unemployed information technology professional, had said that she was willing to work in a bar at night and had worked in a cafe.
She received a letter from the job centre telling her that an employer was interested in her "profile'' and that she should ring them. Only on doing so did the woman, who has not been identified for legal reasons, realise that she was calling a brothel.
Under Germany's welfare reforms, any woman under 55 who has been out of work for more than a year can be forced to take an available job ? including in the sex industry ? or lose her unemployment benefit. Last month German unemployment rose for the 11th consecutive month to 4.5 million, taking the number out of work to its highest since reunification in 1990.
The government had considered making brothels an exception on moral grounds, but decided that it would be too difficult to distinguish them from bars. As a result, job centres must treat employers looking for a prostitute in the same way as those looking for a dental nurse.
