Why does Majesty 2 install directx9 when I have windows 7?

it doesn't even offer to install it it just goes ahead and installs it without any say on my part.
Then weird graphics glitches start happening. My NVIDIA drivers crash and recover and the whole system becomes unstable.
Is there any way possible to install just the game?

Because Windows doesn't offer real package management for them to just depend on a specific version of the DirectX libraries and developers blindly do what they think is best to your machine even though it's usually not the case.
