why can't i patch ut2004?

i recently did a new windows installation, partitioning my main drive so as to have a place to install large games and keep mp3s etc so i can keep them between windows installations. i did an ntfs quick format from within windows. i then installed ut2004 and tried to patch it. when i try to patch it gives the error:

Failed writing destination file : e:\ut2004\system\ut2004.exe (this process cannot access the file because it is being used by another process)
The destination drive might be full, or it might have bad sectors.

I did a scan with western digital data lifeguard and found no bad secotrs (just a few days ago). the drive is not full. i can't figure out what might be using my file - i turned off realtime virus scanning in NOD32 but still no luck.
and i also cannot uninstall the program now! the uninstaller just doesn't run now... but i can still play the game, just not connect to any servers because i'm not patched...
any advice?

edit - after using the "UT2004" registry fixer by Spaz, i fixed 2 problems with the registry, the Protocol File Type Information and the Uninstall Path. however i still have the same problems - can't patch, can't uninstall.

Try booting into safe mode, blowing away your UT2k4 directory, then boot Windows normally and reinstall.
