No, he exceeded his 12 week allotment of FMLA job protection. All his boss has to say is that he was terminated for excessive absenteeism outside of the FMLA protection.
Note: This is under the assumption that they did not grant him this time off under a personal leave, and, as he has yet to explain to me how he got >12 weeks of time off, it is the assumption I will operate under.
Edit: Granted, his company will still have to pay out the ass even to settle a lawsuit, so if he wants to be a dick, he should go ahead and file.

He was very careful not to give one but I did ask. He simply said that they had decided to pursue other staffing solutions. Works for me, makes for a quick and easy unemployment claim!
