I have been on FMLA leave since September. My doc and I finally decided that it was time for me to go back. I have to be back to work at 10am tomorrow. My boss is a super control freak guy, so I know it made him mad that I took the time off. Plus I bypassed him and dealt with HR directly.

So...who thinks I am going to get canned tomorrow? Michigan is an at will employment state, so they can fire me without reason if they choose to.

Short version:
I got fired.

Long version:
I got to work a little early after stopping of to take advantage of my McDonalds buy one get one breakfast sandwich coupon. I didn't want to go in hungry. My manager was there and I sat around and bullshitted with him for an hour or so. We went outside to grab a smoke and I asked him what I was going to do today. He said that we were waiting for the Area Director to get there. That wasn't a good sign, since the AD literally doesn't even know how to get to our store. We sat around and chatted until the AD got there, then had to wait for him to get off his cell. The whole exchange took a couple seconds, but he told me that they were not going to continue my employment. I said fine. They asked for my company issued BlackBerry and I proceeded to wipe all texts, emails and browsing history and took out my memory card. He asked if I had any other questions and I said I just had one.

"My kid's mom ran up my bill last month. Can you take care of that for me?"

He started laughing and said he could see why I am so successful in sales. I am never afraid to ask for what I want. Then he said no.

Not 100% true. They have to let you back into the building and give the appearance of you resuming a comparable position to what you had. Once that's done, THEN they can fire you.

If they s-can you before then, you'd have a case that they were retaliating against you for taking FMLA leave and you could sue their pants off.

Really now? I did not know that.

My one saving grace may be that we are getting bought out. I wouldn't think the boss guy would care too much knowing that we are all probably getting let go in June.

I was thinking the same thing. I would think they'd have to have some other good reason to fire you or it will definitely look like retaliation and I doubt they want that. Of course they could just wait until a few months down the road and come up with something.

Exactly. FMLA puts you in a delicate position, if they fire you right away you could argue that it was because you took time off. No, they will need a legitimate reason to fire you tomorrow.

I was out because of post acute withdrawal syndrome. Basically I was in a deep depression, my short term memory was gone and I needed some time to just get better. I'm still not 100% but at some point I need to get back to normal life.

What did you withdraw from ? I'd imagine legally they could fire you, because whatever you were doing that caused the syndrome is against their policy.

Alcohol and Xanax.

The Xanax was prescribed to me legally and the alcohol...well I work in sales. If they could fire people for being alcoholic, there would be no sales force left.
