who issues search warrants?

a judge has to sign it i believe. and if the people that filled it out screw it up, anything that they find they cant use as evidence.

so who do you call to find out if a warrant is real or not? and how do cops get them at 3 in the morning?

you should get a lawer involved if you think a warrent is not real. did they issue it at 3am or just execute it at 3am?

maybe its like training day, they rob someone so they can pay the judge to sign it at 3am :)

well, no warrant was issued for my friend who had his house invaded by 5 cops for suspicion of underage drinking.... We just got into the argument of warrants, and who issues them and who can be called to validate the warrant.

they wake up the judge in the middle of the night and have 'em sign it.

yeah. if they see illegal activity then they don't need a warrant.

based on what I am reading on some legal web sites, they still might need a warrant. The only thing that brought them to the house was a parking complaint. Its a very touchy situation, yes, but they still didn't have the right to go into the house. The party itself wasn't out of hand, its just that someone parked in the wrong spot.

Generally they will need a warrant to enter, unless there is some kind of emergency (e.g., a fleeing felon enters the property). Cops can and do get warrants signed in the middle of the night - I remember many a phone call to our house when I was a teenager (my mom has been a judge for about 20 years), asking for warrants to be signed. It's important to understand, however, that if the property resident consents to the police's entry, they have waived any issue as to the validity of the warrant (or lack thereof).
