Well, I have tons of updates but none of them have anything to do with the topic. I called the detective a couple times and keep missing him.

Had this exchange with the LL earlier in the week

LL: TJ, have you made any progress with getting the Citibank form signed, notarized and submitted for recouping your money?

Me: The only day last week that I was able to get to the bank was Thursday. Patrick was not there so I was not able to make any further progress locating your money. I left a message for Detective Hudson seeing if he made any progress as well. I have yet to hear back from him. Because of my new work schedule the only day I can get to the bank before it closes is Thursday since that is the day they are open the latest. I'll try again this Thursday.

LL: I just spoke with Patrick. He said plans to be at the branch on Thursday, but cannot guarantee it because he is always being pulled to meetings. He also informed me he does not have to notarize the form, there are other notaries in the branch that can do so. He encouraged me to tell you to come in and deal with anybody who is there. The form gets sent to the operations department to process. Nothing is done on the branch level, so there is no need to deal with Patrick.
I will relay this message to Detective Hudson.

It's not your money that needs to be returned, it's his money that needs to be returned to him.

I don't understand why you're even doing this.

He has a Chase checking account and the check was cleared through a Chase bank. He lost the funds, it's his problem.

I don't understand this either. This thread frustrates me.

From the very first post:
I check my account today and it shows the check as being cleared. I send him a text saying I guess you got the check yesterday and cashed it. He tells me no. I pull up the account and it shows his signature and his account number on that check.

That's where TJ's involvment in this whole situation should have ended.

No, it should have ended when LL said he never received it, then several days later admitted he actually did have it at some point.

Exactly what are you attesting to on this form at Citibank? And why is LL saying "...recouping YOUR money"? Isn't it HIS money that is missing?

Again, I caution against stating anything other than FACTS you know first hand.

Nope. That's the number my LL gave me for him.

I spoke with the detective last night and we are going to go to the bank today. He wants me to fill out the form to "get things over with". He didn't have any further information but he said that he speculated that a family member had deposited the check.

So your landlord hired on the detective and not you, seems the landlord really doesn't know what's going on either.

I just spent 2 hours reading this thread. Which has been totally captivating. I have a question:

If you have one or two attorneys why haven't they managed the correspondence with the LL? It seems like they just tell you what to write and then you write it. The point of an attorney in this situation is that they write what needs to be written and only what needs to be written. You also lose the scare factor when it's not coming from your attorney.

Recently the LL stated he was waiting for your attorney's information. Well if all correspondence from you to him had gone through your attorney instead then he wouldn't be in a position to make such a claim. You should have stepped out of this a LONG time ago and let your attorney handle it 100%.

He has a detective asking him for a minimal amount of compliance which was explained to him would help him in a court judgement should things escalate to that level. Other than that he had pretty much washed his hands of it (as evidenced by the LL whining about the difficulty in getting a response from him).

The OP has handled this entire situation extraordinarily well. It's easy to sit back and armchair quarter back everything when you're not the one living the stress and emotion of it all. His only mistakes in my opinion:

1. He should have been more direct in calling out the LL on his lies. "You lied about the check and now I'm supposed to do a bunch of legwork for you? Up until now you haven't lifted a finger to maintain this property or help me in any way and now I'm supposed to help YOU get YOUR 2500?"

2. He should have been more direct in illustrating exactly whose responsibility the missing funds were. It's true he said it was the LL's problem but he never really laid it out in plain and simple terms for him. A simple statement to the effect of "I spoke to the bank, the authorities, and my attorney: they all agree that once you signed the check payment was received." OP came close to saying this a few times but the message was always a little too muddied.

3. Above all else he should have handed this over to his attorney 100% the moment he decided he would no longer act as the LL's secretary/bitch. He should have known that withdrawing his effort would have escalated matters because you're already dealing with a LL who's as wildly confused as alkemyst as to whose money was actually lost and consequently whose responsible for recovering the "missing" funds.

Given all of that I think the OP did as well as anyone would have since he was dealing with this in real time.

im trying to get my tenant to start making payments though paypal because i have been having similar issues. its always the same shit- "its in the mail! just wait!" as if i dont know it only takes 2 business days to send stuff in post. whatever, we can start doing online payments and then there is no excuse and also no chance of money getting lost. (especially since he sends money orders!)

You can also set up automatic transfers from his bank account to yours.

It doesn't take 2 days to send things via mail though. You get lucky much of the time.

If you are flipping out over rent due on the 1st that gets to you on the 4th or 5th, that's a bit nutty.

I usually pushed my rent so I end up about a month ahead. I'd still have a landlord calling me on the 2nd saying he didn't get my payment or worst putting a notice on my door.

I'd give that sonofabitch hell. Every apartment I have left has been nicer than when I moved in.

oh yeah, you know my bank does this thing called "money link". its like their own paypal service. i should look into that too.

problem is the guy doesnt even have a bank account! hence the money orders! hes 47 and im 29! whatever though, as long as he keeps paying.........

he was 37 days late last month. and has been at least 10 days late for the last 4 months. and i have yet to charge him a dime in late fees (late fees that are clearly stated in our lease agreement). i dont think i could possibly be any nicer.... but i do need to send him a notice that i cant accept late payments anymore, and if they are he has to pay the late fees. not only do i lose out on those extra dollars it hurts my credit....
