On a different note, just because the check was cleared and posted to your account on the 6th, doesn't mean that the money was sent and posted to his account on the same day. It can easily take a week for deposits to "clear" and be posted to your account, especially for large sums. When I wrote a check to another one of my accounts when I bought my house, the check cleared my bank the next day, however the deposit didn't show up in my other bank till 3 days after that.

I would not be surprised if his money magically appears in 2-3 days time.

This is exactly what I am expecting.

LL: "oh the check cleared and is in my account. i have no idea what happened"

the thing is the LL should have talked with his wife before accusing me of not sending the check. he wasted my time and energy trying to find out what happened to it when it was in his/wife's possession the whole time.

This should be over once you have shown him evidence that the check has cleared. It's out of your hands. He should be able to straighten up any problems with his bank on his own, and he should give you credit for the payment immediately.

Not sure why you need to do anything but show him the proof of the check itself having his endorsement signature on it. He claims the money is not in any of his accounts? His problem, not yours.

It's all relative to where you live. I rented a 2br/ba townhouse in FL for $300 a month. I was also making $1000/m. I still pay the same ratio of living cost to salary

Print out everything, show him all the dates/txts/copies, etc and go down the list in chronological order and tell him in his face that he is a fucking liar and trash (he sounds like trash from your post).

Cool! I thought about moving down there. You can buy a mansion for under $350k. Same houses go for 750+ here in NY. No job openings down there right now so I'm going to stick it out here for a while

He goes to you because he never saw it, and tells you so... Then finds out through wifey that she tried to cash it and she tells him it didn't work because of the date, meanwhile she's on a shopping spree with your rent check.

That signature is just a couple scribbles, it's very possible it's something she did. If you're a good tenant it's unlikely that he's trying to screw you.

all of that scenario is irrelevant to his side. he shows the check cleared his account by his signature. if his wife signed his name, he can pursue his cash from her, not the tenant. id have not gone beyond proving the funds went to his account from mine. if they have cash problems on their side its not my problem, personally or legally IMO.

This is what he messaged to me

"According to my bank, your bank holds all of the ability to do anything. They can see where it was deposited and into what account and get it back. Once we find out who deposited the check we can talk about pressing charges if the bank doesnt do it automatically.
Being in banking for 5 years I would guess they would and just assume let them deal with all that."

I told him I'll call my bank tomorrow to see where it was deposited to. Thats pretty much as far as I'm going. I told him in the future he can make arrangements to come to the house to get his rent. He tells me he's coming the 1st of every month. I said no, we'll make an arrangement for a date between the 1st and 10th of each month.

He then sends me this

"Well be up there Sunday to see the progress of the house (they are buying a new house in the area). I can pickup march check then."

I replied

"No, I'm not giving you another check until this is straightened out. I dont have another $2500 to pay".

Seriously its been 9 months of shit like this over and over. We haven't told him but we are in the process of buying a house. I can't wait to see the look on his face when we say PEACE OUT. We retained a lawyer and have enough information to break the lease.

Unless your bank is totally shit, they have a check fraud dept. Call them, let them deal with it.

don't offend the LL... no matter how big of a douchebag he is...
until you get what you need.

what you really need is in writing via text message or e-mail the following:
LL admitting that he received the check
LL admitting that he signed the check

after that, you can call him whatever you want... so long as he knows that it was in his possession.

it's not your problem if the LL's wife cashed the check and spent the money at Chippendale's... but you need to be protected.

the bigger the fight may become, wiser for you to avoid calling names or getting people offended... again, leave paper trails.

I think I figured out what happened...and it's just speculation.

LL had wife deposit check
LL wife couldn't cash it on 2/29 because of post date on chk
LL wife loses check
LL says I'll just tell renter never got chk

I'm guessing someone found the chk and deposited it with his account number and signature. I caught him in a lie and he just keeps denying it

Wife probably cashed check after first failed attempt.

Account # just confirms to the bank the check is for a customer. There is no indication on the check that it was deposited or cashed. The branch will have to pull the teller's paperwork for the day stamped on the check back and research.

Spent 3 years doing such while going through college.

Yeah thats possible but why hasn't the wife admit that she cashed it? They're married and they live in the same house together.

My bank said there was nothing stamped on the back because it was either cashed via a mobile app or at a ATM.

I called the bank again tonight to see if they could trace to where it went. The bank said it was deposited into the account with the number on the back of the check. She said it says deposit only on the check so its not like they got cash as well.

She recommended that I go to the branch and fill out an affidavit of fraud.
