When is Whisky not real Whisky? When it's Fireball Cinnamon, of course. (class action lawsuit)

Would have fooled me, but the label does differentiate between the 2. They might lose this lawsuit though.

That is odd. The $0.99 50ml bottles I can buy here (California) say whisky on them. Maybe this is some weird regional thing?

Fireball Cinnamon Whisky | Total Wine & More

You can buy Fireball Cinnamon Whisky (NO "E")...the lawsuit isn't about that, but rather, about OTHER Fireball Cinnamon products.

WHY HAVE YOU MADE FIREBALL CINNAMON?
Over the years, we have received feedback from consumers wanting to purchase Fireball Whisky in a wider variety of convenient shopping locations, including stores that can only sell beer, malt beverages and wine products. In order to meet this demand, we developed a great tasting malt beverage and an excellent wine-based product under the Fireball Cinnamon brand name. Both are made using our proprietary recipe, capturing the essence of the Fireball Whisky taste experience consumers love. We can now offer Fireball Cinnamon in approximately 170,000 stores in the U.S. that can only sell beer, malt beverages and wine products, but not whisky.

HOW IS FIREBALL CINNAMON DIFFERENT FROM FIREBALL WHISKY?
Fireball Cinnamon is a malt-based 33 proof product, whereas Fireball Whisky is a whisky-based 66 proof product.
Unlike Fireball Whisky, Fireball Cinnamon can be sold in beer, malt beverage and wine stores for our fans who want a wider variety of convenient shopping locations. Fireball Whisky continues to be available in bars, restaurants, and liquor stores across the country.

HOW CAN I TELL THE DIFFERENCE BETWEEN FIREBALL CINNAMON AND FIREBALL WHISKY PRODUCTS?
There are 2 key differences between the Fireball Cinnamon labels vs the Fireball Whisky label:
  • Any package with Fireball ‘Cinnamon Whisky’ on the front label is our whisky-based product
  • Any product with Fireball ‘Cinnamon’ on the front label, without ‘Whisky’, is either our malt-based or wine-based product

WHY DID YOU CHOOSE 33 PROOF / 42 PROOF AND NOT 66 PROOF?
Unlike Fireball Whisky, Fireball Cinnamon products can be sold in beer, malt beverage and wine stores for our fans who want a wider variety of convenient shopping locations. However, many states have laws that prohibit malt beverage and wine-based products being sold above a certain alcohol content. We chose an alcohol content that would allow us to provide our fans with great tasting products and with as many additional shopping locations as possible.

IS FIREBALL CINNAMON A FAKE OR KNOCK OFF?
Fireball Cinnamon products are genuine malt-based or wine-based alcoholic beverages produced by the makers of Fireball Whisky. They have been developed using a proprietary recipe, capturing the essence of the Fireball Whisky taste experience consumers love. We also have a number of other exciting new Fireball products coming to market this year so be on the lookout for these too!

Saw these on the Rez - I was seriously surprised they were selling hard liquor on the Rez.
And now I know.... it was shitty malt liquor.

You're better off drinking a 40 of 8-ball or chugging some Wild Irish Rose than drinking faux Fireball.

Losers vs Drug Pushers, not a jury you’d want me on. “Your Honor, the jury would like to know why public flogging is not among the remedies.”

Frankly I don't really even think of the original Fireball as real whiskey in the first place (it's not scotch so I'm spelling it whiskey)
I do think this is misleading, but not lawsuit-level misleading. Enjoy your "thirty cents off a bottle of Fireball Cinnamon" coupons, I guess?
