I work with a guy that who for the most parts is pretty cool, only problem is that he comes in to work and smells like he hasn't showered in days. To top that off he wears the same clothes for days in a row. Do I talk to him directly and say hey man you need to use some soap and water? Do I go to his manager(He is not part of the company I work for, he works for the comapny that sold us the tool we use).

I say go to his manager and have them speak with him. It will be better coming from his boss than coming from you.

no law that says he can't smeel bad, he can't be fired for that, so manager can't do anything about it othern then talk to him.

IMO, you should talk to him first, give him an opportunity to take care of his hygiene problem, before getting his manager involved.

most jobs do make you consent to some sort of minimum standards as far as looks and cleansliness...had a guy at my job who almost got fired for the same exact thing

Yeah he could in fact be fired for that.

I'd just stay upwind. We have a guy like that at work too.

they will have to prove that his smell is disturbiting other workers. Just the smell it self is not good of a reason to fire someone, or they will be violating his freedom of expression rights.

lol...if only this were true...i would go into work in a t shirt and shorts...employers can dictate whatever they would like...here in mich its called "at will employment" which basically means you can be fired (or leave) with or without reason

What the hell is "freedom of expression rights"?

Are to trying to equate stench with freedom of expression?

Any reason means ANY reason.

If I wake up tomorrow & decide to fire any employees who show up to work wearing blue I can do that. I don't have to tell them why. Conversely, if my employee wakes up tomorrow & decides to never come back, that is his right.

You could always do what my Dad did to one of the employees he had working for him that smelled. One day he came up and handed a bar of soap and said, "You need to use this now." But if you don't want to offend the guy (even though he offends you) I would just mention the fact that you don't mean to hurt his feelings but that he has somewhat of an offensive odor and leave it at that, if it really bothers him he'll take care of it.

Not true, unemployment isn't automatic and employers can contest every claim.
Employer have won in cases where employee was fired for violance or criminal activities.
