I work with a guy that who for the most parts is pretty cool, only problem is that he comes in to work and smells like he hasn't showered in days. To top that off he wears the same clothes for days in a row. Do I talk to him directly and say hey man you need to use some soap and water? Do I go to his manager(He is not part of the company I work for, he works for the comapny that sold us the tool we use).

 
I say go to his manager and have them speak with him. It will be better coming from his boss than coming from you.

IMO, you should talk to him first, give him an opportunity to take care of his hygiene problem, before getting his manager involved.

yes they can dicate the dress code but im not totaly sure how much they can dicate your smell. I mean if someone cam smelll u a 3 room away then yes.If its only when u are standing next to him that is something else.

I strate up tell people who I work with or work for me if they smell or look like hell.

If they dont like it tuff $hit, I dont need to be smelling their funk.

You could always do what my Dad did to one of the employees he had working for him that smelled. One day he came up and handed a bar of soap and said, "You need to use this now." But if you don't want to offend the guy (even though he offends you) I would just mention the fact that you don't mean to hurt his feelings but that he has somewhat of an offensive odor and leave it at that, if it really bothers him he'll take care of it.

Not true, unemployment isn't automatic and employers can contest every claim.
Employer have won in cases where employee was fired for violance or criminal activities.
