My guess.....not posted for flaming or anything else.

Court will give Secretary of State the right to announce results based on Law as written; which means she can make announcement she was supposed to make on Saturday after 12:00 Noon, which means the "by hand mess" is over and she does include overseas ballots received by Midnight Friday.

I say this because I believe a Court's purpose is to interpret the Law and try to look at Legislature's intent when there is a difference of opinion between Plaintiff and Defendent; Court's purpose is not to write Law which is up to Florida Legislature, although Court's can, and have throughout this land, said a particular Statute is unconstitutional, but such a question (at least from what I've read on the Supreme Court site) is not the question in front of the Court; if I'm wrong, so be it.

Effectively, will mean Attorney General's opinions are wrong because Fla Statute doesn't give him (and he admitted as such as quoted in her brief) any say in election matters.

As to the hand counts, my guess is the Court will have trouble with the hand count mess because each County is using a different standard and are changing them at will, which is unfair; whether the Court will say or opine on such matter is anybody's guess.

Finally, the Court may wimp out and issue a short opinion and leave all of us guessing; problem with this is that Judges watch TV, etc. and see what this mess is doing to normally calm Floridians, so thay may think of issuing some type of ruling on these matters.

Hopefully they will do the right thing and keep partisan politcs out of it (fat chance). They are all Democrats but I was watching MSNBC early this morning and they were saying that one of them was a registered Republican and another, although a Democrat was appointed by Jeb Bush and the previous Florida governor (also a Democrat). Also, many Democrats in Florida are alot more conservative than most, and this could mean that they'd be a bit more centered.
 
Most folks have said the Florida Supreme Court keeps politics out of their decisions.......there is extra pressure for them to make an imformed decision, based on Florida laws, in this case.

When all the votes are final, I think Bush will end up with the presidency.
 
If they follow the law then they will not touch it. If they don't follow the law they will just keep us all in suspense.
 
Got an e-mail from my sister, who would have been one of Wisonsins Electors to the Electoral College had Bush won that state. It concerns the courts and the Elector System as follows:

Federal law says that if the election fails to produce a slate of Electors in any state that the state legislature is then responsible to pick them. The Florida legislature is controlled by Republicans and Tom Freeney, a Republican lawyer who will take over as House Speaker on Tuesday, says that the "question is whether or not the Supreme Court of Florida has any role whatsoever. If they try to interfere with our responsibilties, then we still have to fulfill them."

"Our lawyers tell me...that the legislature has a direct authority and power granted to it under the U.S. Constitution that no state court could interfere with, negate or abrogate," Feeney said.

So if the recounts and law suits go on until Dec 18, the Florida legislature will select the electors and there is nothing the courts, or Gore can do to stop it 😉
