what to do when ripped off on ebay, and neither ebay nor paypal will do anything

in october i was the winning bidder for a compaq server. the total was about $285.

the seller took about 6 weeks to get the item to me because he was careless and didn't listen to my directions about shipping, eventhough i sent him the instructions three times AND he verified he understood the instructions.

the item was described as fully working, and it was said the item would be "professionally packaged."

well it wasn't professionally packaged for one. this 60lb unit was wrapped in broken cardboard and when i got it it was badly battered, and suprise suprise, it wasn't working.

i contacted the shipping company, and did their routine, in packing the item as best i could to resemble the way it was when i got it, and i filed the complaint. they picked it up, did the investigation and delviered it back to the guy.

the problem is this, since the bastard shipped the item late... how late? 5-6 weeks after the item close, paypal wasn't able to file the complaint because it was beyond their 30 day limit. so i was sorta screwed from the get go.

next, the shipping company pays the guy, not me for the claim.

oh yeah... here's the best part... the seller is totally ignoring me... not returning my emails or my calls. i was finally able to call him from a number he didn't recognize, and when he heard me, he flipped out, said he just got back form vacation, and that he'd call me back (but how, i was calling from a hidden #) and then he hung up. so he's not wanting to give me my money backl.

so at the moment, this guy, has the product i paid for, my money, and to make matters better for him, if he gets paid by UPS, he'll have double the money. while i sit here hole in the pocket.
 

did u pay by credit card on Paypal. If so, do a charge back. If not, harrass the guy until he pays up.
 
Isn't it nice to be an ass licking seller and sucks to be a honest buyer? Well, you know the guy's address, SPAM his effing ass until he replies. I hate it when sellers or buyers act like they're special and only reply when they wanted it to. NO EFFING body is that busy. Stop lying, you assholes.

BTW, did you at least pay him through paypal? If not, it's your mistake. I mean with PP, at least you can do a chargeback. And if you use credit card payment through PP, you can call your CC and tell them some ass crack scammed you and have them investigate.
 
i filed a complaint with this internet task agency for reporting net fraud.

i was called by a detective the following day. i explained what happend, and he mentioned that there was no fraud, since i did get the item. i tried to explain that he said it was working perfectly, but he said the damage was caused by shipping, so it would have to go through them.

i guess the part about stating it would be packed professionally doesn't mean anything.
 
the police may help you with your case. you can also threaten him with a lawsuit, if you wish to resort to that. i did such a thing when a guy stole approximately the same amount. it took a long time, but he eventually gave me my money back. i also started contacting people who had given the guy negative feedback on ebay (if your guy is a crook, he should have plenty) and waited for their similar responses ("this guy stole hundreds from me!"). then i emailed the guy back, cc'd the others, and told him we'd all jointly take legal action against him and it's our word against his. he eventually caved in and sent me back my money.

the police could have been helpful -- and should be, if the guy is in the states -- my specific case was from canada and they don't really help americans.
