What The Texas Abortion Ban Does And What It Means For Other States

I tend to agree they will shoot down the ‘bounty’ provision simply because of the absolute chaos that will ensue if they leave it in place.

Probably. With other sates moving to do the same thing they're not going to want this kind of attention going into Dobbs where they are all but certain to make abortion bans legit at state level.

Exactly. They would rather overturn abortion the old fashioned way. If they let Texas’s end run stand then they open themselves up to bounty laws for gun control or whatever else.

So we seem to agree this conservative SC let by a law that was blatantly unconstitutional.

We also seem to agree if the same case came across their desk but it was gun control they would have blocked it.

That makes the court blatantly political despite the whining by Alito.

I don't agree with that at all. I believe the SC will end up hearing this, and they will strike it down. At least the bounty portion of it.

Conservatives can't get it through their thick skulls 70% of Americans are pro choice

Oh, I think they know that. I think that they face a problem that the 30% that are not pro-choice are hardcore Republican donors and voters. So, the GOP has to make it at least look like they are trying to overthrow Roe v Wade, and that is what the Texas law was about. I don't think the GOP ever intended for it to go into effect, they expected the courts to shoot it down right away. The GOP now faces the problem that one or more of their anti-choice bills might be accepted by this SCOTUS. I fully expect to the the GOP to send lawyers that act incompetent to SCOTUS to argue 'for' their bill. It will be like watching the unmade movie "The Three Stooges go to Court". There is going to be some Zang.

The problem is that the then will have allowed a lot of people to be injured by an unconstitutional law. Normally the court would have issued a temporary stay until the courts reviewed it if they thought there was a reasonable chance that the law would be found unconstitutional. The fact that they allowed a law to go into effect that pretty much everyone agrees is unconstitutional means that the court was playing politics.

I actually think they'll shoot down this texas law but not because it blocks abortion but largely because of the mechanism its trying to use.
However, I am afraid they'll let the miss. law go through.

They can also strike down only the bounty portion of the law. Meaning that they can let the portion banning abortions after 6 weeks stand.

This was my prediction a few weeks ago in a post. The SC will strike down the bounty but effectively overturn Roe by letting the 6 week ban stay

Abortion ban is back in effect by the 5th circuit.

It's funny to see greenman constantly try to defend how shitty his party is
I don't believe I've said anything in this thread defending republican's. My position has been, and will continue to be, that it's an absurd law that the SC will strike down. Why is that so difficult for you to understand?

Yet, they didn't when they had their chance and the fifth circuit hasn't twice now. You can't keep expecting institutions to save us from the bad behaviors of your party when your party has been systematically tearing down those institutions for decades.

This is such bullshit logic its insane:

Paxton told the appeals court that the Justice Department has no legal authority to sue the state and said the appeals court must intervene immediately to lift the injunction. The lower-court judge overstepped, Paxton said, by halting a law that is enforced by private citizens, not state government officials.

“A court ‘cannot lawfully enjoin the world at large’ let alone hold Texas responsible for the filings of private citizens that Texas is powerless to prevent,” the filing states.

Can't wait until I can start suing Greenman for driving a truck or the gun store for selling guns.

This is exactly why the Texas law will go down in flames, and what the supreme court needs to kill it.
I simply refuse to believe the court will let this stand. If for some insane reason they allow this stupidity to stand, I'll be on the "pack the court" band wagon the next day.

You already are.

I'm hoping Dems in one of our states smoke out this partisan SCOTUS by banning guns using vigilante enforcement and let's see what they do
