I was at the barber today, and one of the guys there threw the term around as some super-duper secret magical way to get out of trouble if you're ever arrested.

I automatically called bullshit, because... well, it just sounded asinine. Sue me. He told me to hit the internets and look into it for myself. Doing so immediately caused my eyes to glaze over as wave upon wave of legalese tidal waves smashed upon the idyllic shores of my neurons.

So I bring myself to you, ATOTers, secure in the knowledge that one of you out there can summarize this in a way that's not going to require me to spend half a million dollars at law school to be able to understand.

46-9-510. Surrender of defendant. (1) At any time before the forfeiture of bail or within 90 days after forfeiture:
(a) the defendant may surrender to the court or any peace officer of this state; or
(b) the surety company may arrest the defendant and surrender the defendant to the court, any peace officer, or any detention center facility of this state.
(2) The peace officer or detention center facility shall detain the defendant in custody as upon commitment and shall file a certificate, acknowledging the surrender, in the court having jurisdiction of the defendant. The court shall then order the bail exonerated.

Sounds to me like
(a)You got in trouble, so then your friend (or Bad Boys Bail Bonds, Inc) bails you out of jail

(b)They need the money back and you're getting set to move to Mexico

(c)They drag your sorry ass to court and throw you in jail ("surrender the defendant"), and

(d)The court gives them their money back. Everyone is happy, especially your 6'5" cellmate who hasn't been with a woman in 10 years thanks to his raging gonorrhea.
 
Hmm... I'm glad people enjoyed my moment of poetic license, but that definitely wasn't the way I thought surrender of defendant was going to work.

Yeah, it basically means that if you skip on bail, if you turn yourself in within 90 days or your bail bondsman catches you, the bail is refunded. If you turn yourself in or are caught by the bail bondsman after 90 days or you're caught by the fuzz bail is forfeit to the court and the bondsman sues you.
