So I get my package today of stuff I ordered.
MB, HD, and phone accessories all accounted for.
But there is this other box too. Open it up and uh, there are
3 256mb sticks of Corsair PC2400 DDR RAM. All of which will
fit nicely into the three DIMM slots in my new Dragon+ MB.

Am I going to be getting a package in the mail asking me to
return this stuff or what?

what should YOU do?

It's all about what you think is best, you could think of it as they are going to not have enough $ for a bonus for all their employees because you got those sticks, or you could think of it as a christmas present. You decide.

maybe it was a free promo you didnt know about. let them take the initiative if they want it back. it's yours to keep until they ask for it.

Once something is shipped to you, very small chance they'll ask for it back. I ordered a Staples Camera with a coupon that wasn't suppose to work for me ($100 off), they cancelled it for most customers, but for me, it went through. Anyways... stuff like this happens. I would totally keep it. They will not ask for it. It's their mistake and they will learn from it.

sending it back is up to you. but they cannot come back and ask you to return it, it was their fault. It's like those unsolicited magazine subscriptions. i was randomly mailed sports illustrated for a couple of months, so i ask my law prof. if i had to pay for it, nope.

the one thing i would do is double check to make sure they havent charged you for it.

*just to fill you in on a rule of thumb at AT, if you receive anything unsolicited and post about it in ATOT(in this case, , you have to give it away to the3 sticks of ram, you have to give it away to the first 3 people that reply to your message* :Q

Hmm so they odds are they are not going to come a callin this stuff eh.
Well I also bought 512mb of Crucial PC2100 last week from Best Buy cause it was
so cheap and my DDR upgrade was in the works.
Guess I will use the Crucial for awhile, wait and see if they do take any action.

Oh and BTW the sticks are selling for $99 bucks a piece, so thats eh ah $300 bucks!

From an ethical standpoint, you should probably return it. THat's a chunk of lost money, and maybe even someone's job.

From a legal standpoint, it would actually be illegal for them to ask for it back or demand payment, AND, if it wasn't plainly marked as a gift or free sample, it's technically illegal for them to have sent it to you to begin with! This is part of the laws governing mail-order merchandise, which you can easily track down on the internet.

Hey thanks for those links.

I check my credit card and there was no extra charge and if there was I could sue them according to FTC website.

For the moment. Basically, I ordered one thing and they sent something else. In clear violation of another part of that same link that says you may not ship something materially different, even if it's better, without the consent of the buyer. What I was sent was not only different, it wasn't even better. When I called them up and asked they said that what I thought I ordered was a mistake and should never have been listed, so they sent something else instead.

I considered reversing the charges on my credit card b/c I never received what I had ordered and also keeping what I received because I never ordered what they sent.

But that's a shady thing to do at best, and I'd LOVE to see it hold up in court.
Anyway, to add insult to injury, what they sent me was defective. I RMAed it, but it supposedly has to have been returned within 10 days in order to get a refund/repair. Otherwise, there's a $20 charge + the cost of repairs, which could exceed what I paid for the item. Now, I submitted my first support request within a day of taking delivery. However, it took more than 10 days for them to troubleshoot everything.

To cut a long story short, if they try to bill me for the repairs, I'll ask for a refund and if they refuse, I'll charge back my CC and cite this rule if I need to.
