In a growing number of states (not most, but it will be), rape begins at the moment the woman gives any indication she doesn't want to have sexual contact, no matter how ambiguous or passive, or how unambiguous or forceful, and without any regard to the circumstances, including whether or not she consented at any time.

For example, a recent California appellate court redefined rape to include unequivocally consentual intercourse where the woman just decides in the middle that she has better things to do, and the man doesn't stop at the precise moment the woman gives some inkling, no matter how passive or unassertive, no matter how unexpected, that she would rather that the intercourse not continue. That inkling may be expressed in any way the woman sees fit, ranging from an unassertive 'sigh' or 'wait' to an assertive 'no' or 'stop'.

So rape is now that you, as a man, could be seduced by a woman, lead to the bedroom by the woman, all sexual contact initiated by the woman, penetration assisted and facilitated by the woman, and you two could be going like Gorillas in the Mist for three minutes, at which point the woman decides she needs to go home to put fabric softener in the laundry, and quite unexpectedly announces 'I've gotta go', and if you fail to stop at that moment but continue for another 10 seconds if for no other reason than your disbelief that anyone would just say 'I gotta go' in the middle of sex, then you deserve to be in prison along with men who break into a woman's home in the middle of the night and forcibly rape her at knife-point, because its the same. Rape is rape.

You deserve to be registered as a sexual predator in your state and be obligated to inform police of your change of residence or get permission from a court to leave the state, for the rest of your life, just like child molestors do because its the same. Rape is rape.

At least that's what California courts, and a growing number of states, have said. This doesn't remotely resemble what constitutes rape in the minds of the vast majority of the public, including women, but that's what constitutes rape to the misandrist feminists who want to make absolute and sacrosanct a woman's prerogative to conduct herself in any manner she deems fit, and make all offenses to woman's prerogative morally equivalent - the equivalent of forcible rape - for which men can be sent to prison.

In Ohio, the age of consent is 16, and being a minor has absolutely nothing to do with a rape case.

Well statutory rape does exist, but here in Alabama it is 16 as well. Sparky just needs to pay more attention.

Rape in the first degree.
(1) A person is guilty of rape in the first degree when such person engages in sexual intercourse with another person by forcible compulsion where the perpetrator or an accessory:
(a) Uses or threatens to use a deadly weapon or what appears to be a deadly weapon; or

(b) Kidnaps the victim; or

(c) Inflicts serious physical injury, including but not limited to physical injury which renders the victim unconscious; or

(d) Feloniously enters into the building or vehicle where the victim is situated.

(2) Rape in the first degree is a class A felony.

Rape in the 2nd Degree
RCW 9A.44.050
Rape in the second degree.
(1) A person is guilty of rape in the second degree when, under circumstances not constituting rape in the first degree, the person engages in sexual intercourse with another person:
(a) By forcible compulsion;

(b) When the victim is incapable of consent by reason of being physically helpless or mentally incapacitated;

(c) When the victim is developmentally disabled and the perpetrator is a person who is not married to the victim and who has supervisory authority over the victim;

(d) When the perpetrator is a health care provider, the victim is a client or patient, and the sexual intercourse occurs during a treatment session, consultation, interview, or examination. It is an affirmative defense that the defendant must prove by a preponderance of the evidence that the client or patient consented to the sexual intercourse with the knowledge that the sexual intercourse was not for the purpose of treatment;

(e) When the victim is a resident of a facility for mentally disordered or chemically dependent persons and the perpetrator is a person who is not married to the victim and has supervisory authority over the victim; or

(f) When the victim is a frail elder or vulnerable adult and the perpetrator is a person who is not married to the victim and who has a significant relationship with the victim.

(2) Rape in the second degree is a class A felony.

Rape in the third degree.
(1) A person is guilty of rape in the third degree when, under circumstances not constituting rape in the first or second degrees, such person engages in sexual intercourse with another person, not married to the perpetrator:
