ok I know he broke into your house...but he was sleeping on his couch and not posing a threat at the time he kicked him. The guy who owned the house then proceeded to knock him in the face. He could have just let him sleep until the cops came...that would be the logical thing to do.

Now we live in the USA....could the guy who broke into the house press charges of assault?
