What happens to Joe Biden's senate seat?

If he becomes Vice President, can he still be a Delaware senator?

So he gets to vote in the senate as a senator, and acts as a tiebreaker as VP?

Or does that seat get given up to the Republican challenger? Or is there another election for it?

Someone will be appointed by the Governor, I believe.

If not, there will be another election.

It kind of depends on the state constitution/laws, which I am not familiar with in the case of Delaware.

1) No.

2) If he wins the senate race, he'll probably forgo it and the seat will probably go to another person from the same party. Of course, this all depends on the rules of that state. There could be a special election, the state governor could appoint someone, the legislature could do the appointing, etc...

I'm curious about this too since Kerry will be appointed to Obama's cabinet. And that loser Deval Patrick will be going to.

I believe in most states, the governor will appoint the new senator. otherwise there'd be a special election, but in either case, it's a safe D seat (same with Kerry if he leaves the senate, and I'd assume in the case of Deval Patrick, the lieutenant governor would step up until the next scheduled election... I've had a lot of experience with unelected government living in NJ :p)

The governor will appoint someone and then in 2010 they will have a special election to fill out the remaining four years of the term.

Usually, the person appointed will be of the same political party as the governor of a state who is doing the appointing

From what I've heard, Beau Biden is generally desired to take his dad's seat but he's going to Iraq for a couple years. The governor will appoint the replacement but it could be the current governor or the new governor (both Democrats) because it depends on when exactly Joe steps down. An agreement may be worked out that a Democrat will serve for two years until Beau comes back from Iraq.

No. Clinton is better suited to the Senate and will better serve the country there. She will be wasted in the cabinet.

Kerry was interviewed and he mentioned that he has been spoken to about it by Obama.

Rumor has had it for a while that it's a lock that Obama will bring his buddy Deval to the White House.

The Gov will appoint someone to fill the seat until 2010 as Prof J said.... that someone will be J.Beau Biden... the State's AG... He's in Iraq atm, however, I've no doubt he'll get the appointment or failing that it will go to someone to 'hold' the seat until he can run in 2010.

Political scramble if Kerry joins Cabinet

If kerry gets appointed there's a special election for the new senator. Not sure how this works but its what I heard on the news the other day.
