What do you think about this water bill situation for all the tenants in my complex?

We now have to pay for water but there's a catch to it. There are no individual water meters for each unit so the rental agency took upon it's self to distribute the billing based on square footage of the rental unit. They are also billing us through an out of state collection service instead of offering billing with our local municipality. Does anyone see a couple things wrong here?

yasha, so why are you wasting time posting here? Go and start reading up on your local state and city laws regarding this. Speak to a lawyer too. I would expect it to be illegal for them to do what they are doing, however they may know different if they have a large number of properties. I would expect the law to state that they have to install individual water meters for each apartment if they want to bill the tenants individually.

That's illegal in Minnesota. Get together with some other tenants. Try looking up the laws, or consult with an attorney or a judge if you know one.

EDIT: You might check with the attorney general's office too. They might get a judge to lay the smack down in a hurry if it's illegal. If the owners want the extra money, they should just increase the rent at lease renewal time. Then it becomes your choice to pay the additionl rent, or move out.

I did a little research and found out that water has to be billed through the local manicipality. I refused to pay for 4 months and was given an notice to pay or move out. Of course I paid it but I had a talk with the manager first. The water that's used for washers in the basement and everyone's use in the building and complex for that matter, is calculated in. Even the sprinkler systems are included. One guy in my building is starting a class action suit and wants certain paper work from me to be part of the suit. He wats a copy of my rental agreement and water bills. I think only the lawyers are gonna make any money off this. I don't trust these lawyers with all that info on me.

Every apartment I've lived in New York State in the water is covered in the monthly rent.
I find it quite odd that they are not including water in the rent.

I'm curious what your lease says, if it says that the waterbill is the landlords responsibility then.........

soybomb> I'll post what it says when I get home. The wording is tricky but it sounds like I should only be paying for my own utilities . I'm curious what you guys would think of the wording. Hopefully you'll be on later tonight.

yasha, why on earth did you pay? If that is the law you should have informed them when they first tried to con you.

I didn't pay for the first 4 months but I got an notice that I have to or I have to move out. I think it's better to pay now and fight it in the mean time. If what they are doing is illegal, then by them accepting payment, it shows some kind of fraud on their part.
