If someone sends you something in the mail that you didn't ask for, legally it is yours. They cannot force you to give it back if they find out their error. You could be nice and give it back, but you aren't legally responsible to.

If it is staples.com, I will probably keep it since they have screwed me in the past.
Ofocurse, I will check my CC statement to make sure I wasn't charged....

I would call and ask them if they want it back, also asking them to pick it up. In fact, I have done that, and companies have sent UPS to pick up an item. Some companies offer a "thank you" credit to be used on the next order. And some have just told me to keep the stuff (such as two copies of a VHS tape someone once sent me). Credits and offers to keep the stuff are nice, but the most important thing is that offering to send it back is the ethical thing to do.

well, i would definatly not shell out the cash to send it back. i'd call and say, "send me money so i can send it back" and then send it back.

once i ordered a hard disk, but received a box of 5. i phoned them up and arranged for a UPS pickup. what you do depends on your ethics. what would you want the other person to do if the situation were reversed?

Legally, if a company sends you something that you did not order, it is a gift. You have no legal obligation whatsoever to return the products. At least that's how it is in Ohio.

Is your conscience only worth a video card? $1200?

I wouldn't be able to live with myself. Heck, I even correct cashiers when I know they've under-calculated my total.

Call me old-fashioned, but I say call them & offer to send it back.

8ball and Zemmervolt, your interpretation isn't exactly right. Your right to keep unordered merchandise only applies when what you receive is completely unsolicited; IOW, if you have ordered something from a company and get something extra from them, that doesn't qualify.

The purpose of that law was to prevent people from being shipped something out of the blue and then be expected to pay for it or return it.

You probably don't have a legal right to keep "extra" stuff, but realistically your obligation probably ends by notifying them they shipped you too much stuff and they should contact you to make arrangements to have it returned. If they ever make a fuss later on, you have documented it ahead of time.

I am a bit disappointed seeing how many people are saying to just keep it. They justify their advice by saying that since customers have been "wronged" in the past, you are allowed to make up for it now. Or they state that since companies are always ripping off consumers, it's okay to get payback. I'm curious about how those who offer such views would offer an ethical (not religious) justification for them?

I had this happen with my Kenwood True 72x... They sent me 2 and I kept them both, only got charged for 1. (when i bought it, it was going for about 100 bucks)

they cant demand it back, its yours. honestly, I would have sent it back if they had even contacted me about it... but they didnt. so its all mine.
