What a way to end the year...

Here I am in front of my desk with the worst back pain in the world. Some idiot was not paying attention at the wheel and rear-ended a lady, whom in turn, rear-ended me. He was probably going 50 MPH. Happy New year!

Anyways, the CHP took my info and asked me a few questions. What should I do next? report it? to my insurance company or the person at fault? In this case, who is at fault, the guy that caused it or the lady that hit me?

Also, should I just go to a doctor and get my back checked? Who would pay for the bills? Man I can't believe this shit... I won't sleep tonight because of this pain. Any suggestions?

call your auto insurance provider? they can probably recommend what course of action to take, especially if you have a police report handy when you talk to an agent.

everyone will get fucked in the ass via a non-insured motorist at some point, may as well be an entire class of "wtf to do in these situations" in high school these days

and to add to my luck, I have been severely sick the past two days, soar throat, fever, achy muscles and nose bleeds. What a year...Ill call my insurance tomorrow (if they're open)...

If CA is a no fault state (I'm guessing it is), then your insurance company will pay your medical bills and then get the money back from the insurance company that covers the guy who caused the accident. The guy who caused the first impact is probably responsible for your car too.

Always always always report it to your insurance company... Don't forget to declare your pain and your eventual doctor visit.

You could just call your insurance and ask them what you need to do and advice on medical/getting car repaired, etc. I have AAA and, after my car got broken into last week, I called my agent and he was very helpful getting a claim set up and walking me through everything I needed to do. My agent's like my bro, man.

1. Go to the ER
2. Check if you Medical Payments Coverage
3. Check to see if you Unisured/Underinsured Coverage
4. If you feel you are being shafted, see an attorney

While you are obligated to talk to your insurance, don't discuss the accident with the other party or his insurance/lawyer.

Back pain? Jeebus, dude, go to the hospital. There's a possibility that you're really fvcked up. You don't want to aggravate the injury. What if you wake up a paraplegic cuz a bone shard severed your spinal cord?

Call insurance agency second.

I am trying to contact them but the agency seems closed. Ill call them first thing tomorrow. My back pain has soothed a bit to the point i dont need the ER but I will go to a doctor regardless.

EDIT: turns out that my soar throat is Mono...I dont think it could get any worse....:(

EDIT 2: Just talked to them and everything went smoothly. I will probably have the CHP mail me a copy of the report. Also, what kind of doctor should I go to? I have no health insurance and no family doctor, etc.

without any health insurance, you may be limited to an ER. The most they will do is an x-ray and basic meds. If you have a head injury they may do a CT scan.

If you have already contacted your insurance company get ahold of a personal injury attorney. He will refer you to an orthopedist and you won't have to worry about the bills. Don't be an idiot and try to take care of this yourself, the insurance company will bend you over and fuck you in the ass with a glass impregnated dildo.

Yes I know...It was not as hard as it couldve been but my back sure didnt think so...although the pain soothed a bit (maybe cuz of my mono).

The damage sure looks like is more than what the car is worth...damn...i liked that car :(

1) Contact your insurance agent, or if he/she isn't available, call the 800 number for your insurance claims office.

2) Go to the emergency room. Get checked out. That's why you (presumably) have medical payment coverage in your policy. (unless you only have property & liability coverage)

3) Contact a reputable attorney. If you don't have one ask friends and family...DON'T just pick one out of the phone book or off the television ads...:p

I don't know if Kahleeforneeya is considered a "No Fault" state or not, but let your insurance company represent you in dealing with the other drivers' insurance. That's part of what you pay them for...Your attorney MAY have to get involved...but not usually. The attorney usually only comes into play (a) if the other insurance company tries to play nasty, or (2) you need/want to sue for damages and injury.
