Man that sucks, that car looks messed up. I can drive while talking to someone but I hate to do it.
 
damn. that's a lot of damage. you may not get it all if it's more then the car is worth. the car, apart from the damage, looks pretty good. hope your insurance won't go up since you weren't even in the car.
 
If the wheel really did get pushed in like you said there's some pretty good suspension damage. Like most have already mentioned it's likely the car is totaled. If so make sure to check with the other party's insurance to see which will give you a higher price for your car. Also since it wasn't your fault your insurance will not go up unless it becomes a common occurance.
 
It cracks me up how some people say that talking on a cell phone is not a distraction while driving...:roll:

Edit-Your car looks like it might be a total loss. What's the KBB value of that car anyway?

In trade in value, which i bet is what insurance companies pay when its a total loss, and in good condition (which what it was before this), it's worth ~1500 🙁.

I have a pretty damn good stereo in it which now I would need to rip out 🙁 got windows tinted a year ago and an alarm two years ago 🙁

FWIW in the UK it's actually illegal to drive whilst using/manipulating/looking at a mobile phone. Should be the same in the US IMO.

Yeah it should to be honest, or at least make you use a handsfree device.

So options as it stands now - I called the dude and told him the estimate, he said he will call back once he gets off work.

A. He pays $3600 out of his pocket for the repairs.
B. He buys my car for $3600
C. He says "HELLL NOOOO", and I make a claim with his insruance and get the total lose value for it.


Soooo yeah...

Report the accident to the Department of Motor Vehicles within 10 days if someone is injured or killed or if damage to either car is more than $500.

DMV Traffic Accident Report Form (SR-1) link

Complete and file a "SR-1" with the DMV. If you do not, DMV will suspend your license until you file a SR-1 with DMV. You can mail the completed report to:

Financial Responsibility
Mail Station J237
P.O. Box 942884
Sacramento, CA 94282-0884
