When I was 18, two friends and I thought it would be hilarious to go to McDonald's wearing Scream-esque masks (one of them looked just like the mask from the movie, the other two were similar), and simply order our food and eat it. This is what you do when you have no job and nothing else to do during the summer months. We waited in line patiently, ordered our food like any other customer, and were enjoying our burgers and fries until the cops walked in.

That Big Mac value meal cost me $223.50 and a disorderly conduct charge.

As for this DJ, that's all he should have gotten. How was he "making a terroristic threat?"

While I would agree it's not an especially bright stunt, you would be WAY outta line in taking him down.

When the judge read me the definition of disorderly conduct, I was aphaled (sp?) at how vague it was. It was something ridiculous like, "Any conduct that could be deemed disorderly or disruptive," or something similarly obtuse. WTF is that? That is bad enough. You could give someone a disorderly conduct charge for posting a funny thread on AT!

I think that is the key. And interestingly, this "I can do what I want, where I want, when I want" attitude is permeating through much of society - it's the new standard for the Politically Correct crowd. The store is PRIVATE property. You have no "right" to go in and do as you please. If the storeowner felt threatened then it is within his right to have the cops remove you. Hell, if you had no shirt on, he could have you removed (NO shirt, No shoes, No service anyone?). Now the matter of the penalty is something that needs to brought up in the legislative process, but apparently there was enough outcry that politicians thought this type of behavior warranted this stiff of a penalty.

Let me put it this way, I have never had someone enter one of my stores with their face covered and NOT had them rob me or my employees.

Concealing one's identity is not a crime. If you don't want them in your store, ask them to leave.

If they leave peacefully or remove the offending item, all is well.

If they don't leave, then you have grounds to bitch.

Until then, IMO, you should be up on assault charges if you pulled a gun on someone like that.
