A California jury on Thursday awarded $172 million to thousands of employees at Wal-Mart Stores Inc. who claimed they were illegally denied lunch breaks.

The world's largest retailer was ordered to pay $57 million in general damages and $115 million in punitive damages to about 116,000 current and former California employees for violating a 2001 state law that requires employers to give 30-minute, unpaid lunch breaks to employees who work at least six hours.

The class-action lawsuit in Alameda County Superior Court is one of about 40 nationwide alleging workplace violations by Wal-Mart, and the first to go to trial. The Bentonville, Ark.-based retailer, which earned $10 billion last year, settled a similar lawsuit in Colorado for $50 million.

In the California lunch-break suit, Wal-Mart claimed that workers did not demand penalty wages on a timely basis. Under the law, the company must pay workers a full hour's wages for every missed lunch.

Good, maybe Walmart will keep taking hits and scale back. I doubt it though.

I do shop at Walmart occasionally, but definitely not my top choice.

If there was ever a case that cried out for punitive damages, this is it. Sam is spinning in his grave over what his company has become.

Now if only they would do the same to Haliburton for the work they are doing in Iraq.. The scour the globe to find the cheapest laborers they can and get them to Iraq and then pay them like trash --- while probably charging me and you $45 per hour for each laborer they pay slave wages

Who wrote this?

Wal-Mart had a little less that 290 Billion in sales for F/Y 2005. If Wal-Maart was a country, it would have the 20 largest economy in the world.

Also, there is already an appeal filed. Methinks that it will be whittled down significantly. REmember, that Wal-Mart has about 1.3 million employees. IF the stories are true, less than one in 12 are accusing Wal-Mart of unfair break policies.

That would be the same as in a Ford factory of 200 people, 17 claim unfair break practices. It's worth looking into, but at face value I still doubt it. I know many people that work for Wal-Mart. They get into trouble for TALKING about work related things at lunch. I met someone who was disciplined because a manager asked them about scheduling the next day and the associate did not tell them that they were on break!

Even if I do try to be a good worker and make my boss like me...what's wrong with that? Oh that's right, we need a huge wedge between employees and employers and they should always be at odds with eachother.

And what does taking a break have to do with making money? It's just free labor to the company but I guess it's your choice...*shrug*

Clue: By skipping breaks and lunch, you don't earn any more money.
