Does that mean noone can advertise the holiday anymore without paying Walmart a royalty?

edit:
Mods- Can you move this to OT? (Didnt realize i was in P&N)

Trademarked, rather than copyright, it seems.

Reminds me of the infamous "George Lucas [or TSR?] trademarks the word Nazi" story (never been quite sure if that was true or not, but I do remember seeing the Indiana Jones Game items where they printed TM next to the word).

Really this goes back to the patent office issuing ridiculous trademarks and not requiring any proof of development or ownership. Just like DNC companies trademarking all the national park names and land marks, also "Space Shuttle Atlantis."

I'd rather companies not own culture. You probably would to if it affected you.

maybe they should grab up all the holidays possible, starting with Veterans Day, and just capitalize the shit out ‘em.

what difference does it make?

I don’t really care, do you?

A trademark is not ownership of the holiday. Lord you guys are dense.

Christmas, 4th of July and many other holidays are commercialized to the max. For example look at Christmas and Coke.

Mountain out of a mole hill in my opinion.

aww, u mad bro?

you voted for this guy, so your opinion is worth exactly $0.00

Why would you think I am mad? Other than you projecting...

I think it is silly and frivolous. I thought the design was fine and see nothing even slightly disrespectful.

"Share and celebrate African-American culture, emancipation and enduring hope."

This has nothing to do with Trump. I don't know why you bring him up in every topic. He really is living in your head isn't he? 🙄

You voted for him twice, I will continue to remind you of that.

TM is a self identification that you are using something specifically as a trademark of your brand or product. It does not need to be registered with the PTO to be TM. If the company wants further legal protection, they need to follow up with an application. Only after successful registration does TM become r-ball.

Interesting, didn't realize that. The broader point still stands though.

I don't really know, but is that not mixing up patents (which do seem to get issued for stupid things) and trade-marks?

As I say, I don't really know, but I'm not sure that trademarks are issued in the same way by the same department as patents.

In the US the patent office is the trademark office as well.

Walmart exploiting folks by cashing in on their culture of whom are the same folks that Walmart exploits as their employees. I guess it makes sense from Wally World's "profits above all" point of view, insensitive as they are.
