Wal-Mart said on Thursday that it would not pursue copyright claims against a bargain-shopping site that posted details about "Black Friday" sales.

In a closely watched move, the mega-retailer invoked the controversial Digital Millennium Copyright Act (DMCA) last month to force F@tWallet.com to delete a list of products and prices scheduled to appear in Black Friday advertisements. Wal-Mart then sent a special DMCA subpoena to F@tWallet asking for the identity of the person who posted the details on the site. Black Friday is the day after Thanksgiving each year when retailers, legend has it, go "in the black" and start to make money.
 
Massive congratulations to f@twallet and the good people at Berkeley.. I only hope they keep going and hit all the retailers involved for damages and fees. Otherwise they'll just try this frivolous intimidation again and again...

Yeah I really hope Verizon comes out on top in this case. I used to work for a small ISP, still get my internet service through them. They think like Verizon does, if it's not law enforcement asking for the users names, they don't give them out. Unfortunatly, being a small ISP, they have no money for fighting the RIAA/whatever. If Verizon wins, it will be a good precident for the small ISPs.
 
It's not over.

Walmart still claims what they did was right, They still claim they were right they just aen't persuing the sopenia. They still feel they have the right to have FW remove the info.

You're right that it is not over until the DMCA is seriously challenged and severly changed.

In a nut shell the DMCA takes all human rights and respect away from individuals and hands complete control of the Internet and all Technology actually, to both Corporations and the Government.
 
I am glad for F@twallet, but didn't Wal-Mart already accomplish what they set out to do by stopping them from posting the BF deals?

I don't want to detract and congrats to F@twallet, but Wal-Mart really had no reason to fight.

"We're satisfied that our copyrights were protected in this case," said Tom Williams, a spokesman for Wal-Mart. "Accordingly, we withdrew the subpoena."



 
This is good news for FW, but I'm afraid it's not so good in the big picture. Some of these cases have to be pushed through (Walmart simply dropped it's Subpoena for information) before the DCMA can be exposed for the dangerous far reaching tool that it is. It basically hands corporations that have the money/attorneys a large weapon to yield against all sorts of people (whether what they post/say is legit or not), with a chilling effect on free speech.
 
I would have liked to see it go to court so a precedent could be set against this abuse. I think thats what walmart was most afraid of so they can continue to intimidate the little guys.
 
To Berkeley's Mulligan, standing up for FattWallet was a way to set a good precedent the next time a similar situation arises.

Maybe FattWallet and UC Berkeley should push this a little more.

The DMCA was ostensibly created to better allow record, film and software companies to better protect their rights.
Unfortunately, they took advantage of non-technical lawmakers' ignorance and basically made everything illegal that they could. The bill is so vague and far-reaching that it ventures well into the world of "ABSURDITY."
 
walmart has to be one of the most ass-backwards stores i know of... i think a few years ago their pharmicists refused to carry the morning-after pill because they thought it caused abortions

huh? Walmart would lose the case......and thus the case would become a precedent, and that would basically prevent this from happening again.

Sorry but I disagree with you there. I beleive they stood by there convictions just as they have on racy cvideo games and are well within there right to do so
