If I was the engineer and the train actually hit the kid and killed him, I wouldn't think that I killed him. The kid would have killed himself in that situation.

no he does need to die. How would you feel if you were the train operator? He probably had a heart attack. What if somehow the train was effected and others lives were endangered because of it?
