I won't claim to know what the law says about this but it seems obvious to me that if your aggressor is still armed with a gun as they turn and run from you, then they are still a valid target.

There is no way to tell if the man was running away or just running to take cover so he could continue to attack.

Exactly, not to mention later in the story it says the cops never even thought of pressing charges, and I am sure they knew more details than included in the story.

I know... I'm saying his dad started to run from him, but he continued to shoot.

The self-defense requirements are way too strict these days anyway. This more than qualified.
