VALVE vs. ACTIVISION

Sounds pretty cut and dry to me; but litigation can be a nasty beast. Valve's strategy should be twofold:

1) Insist the original amount specified by the arbitrator is binding
2) Disprove the claim of an overpayment in royalties (if untrue)

Anyone who's played HL2 with commentary mode enabled should agree, Valve's a company chock full of hard-working geniuses. Valve is a great, great company, one of the best. Freakin Activision..


"In 2005, Sierra and Valve agreed to let an arbitrator decide how much in royalties Valve was owed and agreed that his decision would be final. The arbitrator decided that Valve was owed $2,391,932 including interest.

Activision assumed Sierra?s responsibility due to the fact that the company was acquired and declared that Valve was overpaid $424,136 in royalties; it said that it would subtract the overpayment amount from the ordered payment that the arbitrator awarded.

This is where the conflict started between the two companies, with Valve claiming that no one ever informed the arbitrator of the alleged overpayment and the fact that the companies had an agreement to abide by the arbitrator?s decision." Link

Wait, isn't Activison/Blizzard the guys behind WoW? It would take just take a fraction of one months revenue from that game to pay the rest of what an arbitrator told them they had to pay... seems like they are arguing over basically pennies. Odd...

Vivendi will likely be the majority shareholder of Activision-Blizzard. Hopefully, they will let them do their thing. Vivendi (when they try to manage their subsidiaries) is one of the most poorly run companies in existence that manages to stay in business.
