The person has the right to free speech. The role of valedictorian does not. The person is allowed to assume the role of valedictorian, but then is bound by the conditions of the role.

Maybe an athiest Valedictorian will rip up their speech and start reading a passage from Darwin's Origin of Species book to protest the introduction of creationism into Bio class.

Wasn't it also in the Bible that those who pray or show off their religion the loudest are not really religious; that the ones who are really religious don't show it to others.

So in other words, maybe the Bible is saying instead of going to church, why not be truly religious rather than showing.

But, in this modern day and age, the things on the surface count more - not what is actually real.

sure the school could be sued. anyone can be sued for anything at any time. whether the school should be liable is the interesting question. for me, depends on if the school knew or should have known beforehand that an invited speaker would go off of what they should be talking about.
