i will try to make this as detailed as possible:
i sold something on other forums via paypal (we both registered/confirmed)
i insured the package for the full value and required signature. i mailed the package and week later i got the conformation email saying that the package was delivered and it showed signed as J. DOE (for john doe). this name is pretty rare and i doubt there are anyone else named that way in his town. here is what happened next:
1. i emailed the guy and said it shows here as delivered and i hope you enjoy the item.
2. he replied within few minutes saying wtf i am talking about he has been here all day and nothing came buy (this is is about 5-6pm and it showed delivered approx at 12pm)
3. i reply with similar wtf, it shows its delivered it show him tracking #
(little backround, i sent the item via first class priority mail and he lives within 200 miles from me, mailed it wednesday and it was recieved next tuesday, he emailed me 20 times between, even had me call usps main office to have them track package internallly and then fax me an obscure hub scan that only showed up on their internal system but not on the usps.com(that calmed him down))
4. be basicaly replied he has no idea whats going on/etc i immidiately smell a fish and call usps but they are closed..
5. i call the next morning usps office in his town and speak to a supervisor he says he will look into it and after i call 4-5 hrs later he said that the mailman is off today and he will talk to him as soon as he shows up
6. called the next day, he said mailman called sick..
7. called next day (friday) supervisor said talked with mainman and he said that he never handled that package or delivered to that address(i obviously ask wtf it shows as signed.../delivered) i ask if they have special truck who delivers packages that are insured/require signature (in my town they do that, he said NO they do not, only regular mailman)
8. i am speechless and direct the guy to post office to also speak to them to make sure stuff is on the ball.
9. week or two later and 30 emails between us nothing changed. i called them several times but i just get same bs, we looking into it
10. after about 10 days guy says i want my $ back, i say i cannot i shipped package in good faith. few days later he files chargeback with CC for non-delivery. i reply with tracking and some other info and few weeks later i WIN the case and get my money back. i called paypal to ask if his CC refunded his $, they say they doubt but they dont know.
so here is the question:
1. since the package is expensive and insured for good$, so i file a missing claim?
if so, how will this work if the package shows as being delivered yet mailman said before he did not handle/deliver the item? also last 2 calls i made (last week, its been5 weeks now), supervisor basically says: how can i expect ppl to remember something that happened 5 weeks ago...
2. say i file the claim and somehow win it, DO I HAVE to refund the $ to buyer (not talking about morals, but purely legally).
3. since chargeback was won (few weeks now), i have not heard from the buyer, wtf does this mean, he either has the watch and lied, credit card refunded him the $ or what?
4. what would u do? the item, is valuable and while it's not unique its very dear to me. i only sold it because i needed the $
