One other thing to keep in mind is that some people will leave the AP open and log all the traffic passing through it for later review. Its kinda' neat to see what websites they visit, etc. Of course clear text passwords have then been given away too....

I use someone elses bandwidth on a regular basis because my PDA can detect a connection from the couch. I am doing nothing malicious and am barely touching the guy's bandwidth. I don't feel at all guilty.

I can see the first lawsuit already. HACKER gets 10yrs for stealing wireless bandwidth, connection was not secured in any way, nobody had any way to discern that it was not intentionally made available.

I don't like the analogies presented so far. To me it seems that having a completely open wireless connection is like laying $100 bills all over your lawn and then getting pissed when you wake up in the morning and find that some are gone.

You can argue all you want that they were yours, it was your property, nobody had the right to take them, but the fact is that you're an idiot for doing that, and nobody really knew that you didn't mean to just give the money away anyway.

Ok how this analogy?

Up here in the state of Maine we do a lot of hunting, fishing, hiking, etc. The way things work up here, instead of hunting down the owner of the property you want to hike, fish, etc. on, you just go ahead, if it's not posted. (signs saying no trespassing)

As long as you do no harm, no one gives you any trouble. Well unless the land owner is from N.J. they don't understand how things are done....



Seems to me that if they are going to leave it open, they should expect people to take advantage of it.

I rather doubt if there is any law breaking going on here, these things have only been around a couple of years. Not really enough time for laws to be made.
