used car problem

Hi,

Its been a year, and the car was for my sister. Recently there has been a problem, and she took it to the mechanic. Upon inspection the mechanic said that her car has been in a serious accident. I forgot exactly what was wrong, but that's about the summary of what the mechanic said. I asked my parents and they said that they were never told the car has been in an accident. Is it possible to buy a car that has been in a bad accident and not have a salvage title? Can someone just not report an accident?

If the car has indeed been in an accident, how can we get back at the saleman? Is there a law that says a saleman must say a car has been in an accident? The car wasn't cheap, definately not the price of one that has been in an accident. Are we just at a lost then?

My car was in a bad accident and I bought it back from the insurance company. Had I wanted to, I could have put it back together and sold it. There never would have been a salvage title associated with it. It can happen anyway.

Edit: CARFAX is your friend.
 
you mean they WEREN'T told it was in an accident.

And if a car isn't totalled, it's very possible for it not to have a salvage title.

My car *was* totalled and it didn't have a salvage title.
 
If it was in an accident, then you're screwed. Sorry 🙁. Though, on the "upside", I doubt it would have a salvage title without you knowing, there is alot of paperwork involved with that.

That is just how the industry works, salesmen are very very shady.
 
alabama is one of those states that cars can be retitled at one time..

needless to say do a carfax report on it, if it shows clean it has been retitled as clean that means the that is fraud.
 
You bought a used car and didnt take it to a mechanic to have a once over done on it before buying it??
Now you know why you take a used car to your mechanic before writing the check.
 
darn, so basically we're screwed. Nothing at all we can do? It isn't illegal in anyway that they were deceived? Not telling the whole truth is still lying.

Not telling the whole truth is just that...not telling the whole truth.

If your parents asked "Has this car been in an accident?" and the salesman said "no," then that would be lying...

Anyhow, this accident wasn't revealed on Carfax at all?

Nope, they could easily use the rebuttle that it was fine when they sold it, and it could have been your sister's fault it had an accident. You signed the papers for it, its yours, as is.

Sorry, it looks like you're going to have to take the loss.

Incorrect. They are not obligated to divulge any more information than you request, really. You wouldn't have a legal leg to stand on unless you asked them about its accident history, and they misrepresented the vehicle when asked. And even then, they can easily claim that they had no knowledge of the history being any different than they told it--unless you could find evidence of the accident occuring during the seller's ownership, but if you had that then you probably wouldn't have bought the car in the first place... Sorry.

While there are certainly ways for a salvage title to be laundered, bad accidents do not always generate a salvage title. As long as the vehicle isn't totaled, the insurance company simply pays out whatever is necessary to fix and the car is back on the road. So yes, a car valued at $6000 could have $5000 worth of repairs covered by the policy. (Just throwing out loose numbers, my disclaimer for any nitpickers/insurance agents out there who are about to get all worked up. 🙂)

Anyways, slap yourself for not taking the car to a mechanic for <$50 (or even a handy friend for <$0) beforehand. I'm assuming they got it up on a lift and immediately saw more Bondo than metal.

Honestly bro, used cars are a 50/50 deal at best. I bought 4-5 before finally buying new and 3-4 of them were total crap.

Did you buy it from a dealer,or private?

How old a car?
